Hiring contractors in Austria

General information, not legal or tax advice — confirm with a local adviser before you act.
A foreign company can commission genuinely independent services in Austria, but the actual conduct may instead create employment or a free service relationship. A result-based Werkvertrag, a continuing freier Dienstvertrag, a licensed Gewerbetreibende and a Neue Selbständige are distinct routes with different obligations; see hiring in Austria or employer of record where the work needs an employment model. 4dev.com lists Austria among the countries available for contractors through its Contractor Platform.
Where the line runs between employment and contracting
The line turns on the engagement’s actual economic substance and conduct, rather than the title on its contract. Personal dependency points to employment; a continuing service with limited personal dependency can be a freier Dienstvertrag, while a defined work or success points to a Werkvertrag.
| Feature | Employment | Freier Dienstvertrag | Werkvertrag |
|---|---|---|---|
| Core obligation | Personal work within the client’s organisation | Continuing service | A defined work or success |
| Control and integration | Personal dependency: integration, assigned hours or place, a set work sequence, instructions and ongoing control are indicators | Personal dependency is absent or limited; there is no binding instruction or restriction on personal conduct, the person can organise and change the work process, and the client provides the essential equipment | No personal work duty, no integration and no personal or economic dependency are indicators; the provider uses their own equipment |
| Basis for remuneration | Work performed in the dependent relationship | Time worked | The agreed result |

Fixed daily hours at the client’s assigned place and ongoing instructions point toward employment even when a contract says Werkvertrag. A defined deliverable, the provider’s own equipment and control over the method support a result-based arrangement. A continuing service paid by time calls for separate assessment as a freier Dienstvertrag.
Where contractor status breaks
No monetary threshold decides whether an engagement is employment, free service or independent work: that classification still follows its actual economic substance and conduct. Once the form is established, the following thresholds allocate particular insurance or VAT consequences to that form.
| Freier Dienstvertrag: monthly marginal earnings limit | €551.10 / month in 2026; an individual relationship at the limit remains marginal | USP: free service contractors; USP: marginal employment |
| Neue Selbständige: annual GSVG insurance earnings threshold | €6,613.20 / year in 2026 | SVS: insurance threshold for Neue Selbständige |
| Licensed Gewerbetreibende: low-income insurance exemption | Annual turnover below €55,000 and annual profit no greater than €6,613.20 in 2026 | USP: persons with a trade licence |
| Austrian small-business VAT exemption | Turnover no greater than €55,000 in both the preceding and current calendar years | USP: Austrian small-business VAT exemption |
| EU-wide VAT ceiling for a non-Austrian EU business using the Austrian exemption | €100,000 in both the preceding and current calendar years, as well as the Austrian €55,000 condition | USP: small-business VAT exemption for EU businesses |
For free service, the client registers accident insurance before work starts at or below €551.10; above it, the registration covers accident, health, pension and unemployment insurance. For a Neue Selbständige, GSVG compulsory insurance applies only when annual earnings exceed €6,613.20; without a prospective declaration, SVS may decide after the tax assessment, and a later crossing can require back contributions plus a 9.3% surcharge on health and pension contributions, which can be avoided by reporting within eight weeks of the tax assessment.
The licensed-trader exemption must be applied for and has further eligibility conditions, so it is separate from the Neue Selbständige test. For Austrian small-business VAT, EU establishment and both calendar-year tests matter: a current-year excess of no more than 10% keeps the exemption to year end but not into the next year, while an excess above that tolerance makes the crossing transaction and later transactions taxable. A non-Austrian EU business also applies in its home state and needs an -EX identification number; its €100,000 EU-wide ceiling has no 10% tolerance.
How an Austrian contractor registers
Registration follows the form of the work: the business owner registers an independent activity, while the client registers a freier Dienstnehmer with the competent health insurance carrier before work begins.
| Form | Who registers and with whom | What the client checks |
|---|---|---|
| Result-based Werkvertrag with a licensed Gewerbetreibende | The provider registers the trade with the Gewerbebehörde and reports the activity to SVS; the authority forwards the report to SVS. | Whether the activity requires a Gewerbeberechtigung and whether the relevant authorisation appears in GISA. |
| Neue Selbständige | The provider requests a tax number from the competent tax office when first starting self-employment and deals with SVS under the annual earnings rules. | Whether the activity is one that does not require a trade licence, and whether the provider has addressed the tax-number and SVS steps. |
| Freier Dienstvertrag | The client registers the person with the competent health insurance carrier before the start. | Whether monthly remuneration is above €551.10 in 2026, which changes accident-only registration into broader ASVG insurance. |
Werkvertrag and licensed Gewerbetreibende
A Werkvertrag does not by itself say whether the provider needs a trade licence: that turns on the activity. Where a licence is required, the provider registers the trade with the Gewerbebehörde; the official GISA record is the practical client check. The provider generally reports the activity to SVS and the authority, with the latter forwarding the notification to SVS; the statutory notification deadline is within one month of obtaining the licence entitlement. GISA entry follows only after legally effective registration and the required conditions are met, with entry recorded within three months in that case; this is not a universal start-time promise.

Neue Selbständige
Neue Selbständige carry out covered independent activities without a Gewerbeberechtigung, so the trade-registration route does not apply to them. At first self-employed activity they request a tax number from the competent tax office and file the E1 income-tax return in the following year; SVS’s insurance guidance sets the separate annual earnings test. GSVG compulsory insurance arises only when earnings exceed €6,613.20 in 2026, rather than from a client’s monthly ASVG registration.
Freier Dienstvertrag
For a freier Dienstvertrag, the client—not the service provider—makes the ASVG registration before work starts. At or below €551.10 monthly in 2026, the client registers accident insurance; above that threshold, the registration covers accident, health, pension and unemployment insurance. If several marginal jobs together exceed €551.10 monthly, the person is also subject to health and pension insurance on total remuneration; each client still registers its own relationship at the applicable scope. If the person is fully insured under ASVG and there is no written contract, the client provides a Dienstzettel.

The contract: what it must say
The contract should describe the work model the parties will actually follow, including who controls the work and what result or continuing service is owed. Its wording cannot cure an employee-like arrangement in practice.
Clauses for the chosen work model
For a result-based Werkvertrag, define the deliverable, acceptance standard and the agreed result; for a continuing freier Dienstvertrag, state the service and ensure the agreed autonomy matches the way the work is run. In either form, record the commercial scope, expenses, invoice requirements, confidentiality and record-keeping. State the intended IP licence and usage rights expressly: the scope of a right to use IP follows the licence agreement, so a contractor’s work does not automatically give the client every usage right.
Ending the contract
A Werkvertrag ends on its negotiated terms for the agreed work or result. An indefinite ASVG free-service relationship instead has a default notice period of four weeks to the 15th or month end, rising to six weeks after two years, unless a more favourable arrangement applies; it is not a universal termination term for every Austrian contractor. A collective agreement covers this kind of free-service relationship only where it expressly includes it.
For the first time, statutory notice periods and termination dates apply to freelance employment relationships, restricting the flexibility that has characterised such arrangements to date.

What an Austrian contractor must put on an invoice
An ordinary Austrian VAT invoice identifies both parties, the service and its date or period, the net amount, rate and VAT amount, issue date, a sequential number and the supplier’s UID. The recipient’s UID is also required in the domestic circumstances specified for invoices over €10,000; the VAT treatment depends on the transaction, rather than on the contractor label alone.
Use a checklist that records the supplier and recipient name and address, service description and scope, service date or period, net amount, tax rate and VAT amount, issue date, sequential number and the required UID details. An eligible domestic invoice of no more than €400 may omit the recipient details, sequential number, UID and separate VAT amount, using the gross amount and rate instead; that simplification does not apply to EU cross-border invoices. A B2B invoice is generally due within six months after the transaction.
For a general-rule cross-border B2B service supplied to another EU member state, reverse charge may place the VAT liability with the customer, which supplies its UID. When reverse charge applies, the invoice states the reverse-charge treatment, includes both UID numbers, shows no separate VAT amount, and is issued by the 15th of the month after the service. A small business that needs a UID for EU business relationships may request one using U15.
The small-business VAT crossing transaction
The Austrian small-business VAT exemption requires an EU-established business to stay at or below €55,000 in both the preceding and current calendar years. For an otherwise eligible business, a current-year excess of no more than 10% preserves the exemption to year end but prevents its use in the following year; above that tolerance, the crossing transaction and later transactions lose the exemption.

A business that exceeded €55,000 in the preceding year cannot use the exemption in the current year. The 10% tolerance concerns only a current-year excess by an otherwise eligible business.
An EU-established business outside Austria seeking the Austrian exemption applies in its home state, needs the -EX identification number, and must meet both the Austrian €55,000 and EU-wide €100,000 limits in the preceding and current years. The €100,000 EU-wide ceiling has no 10% tolerance, so its crossing transaction is taxable.

These exemption tests do not determine the place of supply or reverse-charge treatment of a particular cross-border service.
How money reaches an Austrian account
For a euro transfer to an Austrian or other EEA account, the recipient’s IBAN is sufficient; an Austrian IBAN has 20 characters. OeNB’s transfer guidance states that SEPA transfers operate in euro, while other currencies follow different terms, deadlines and fees.
Set the currency and which party bears the transfer fees in the contract rather than assuming a bank’s terms. A standard SEPA transfer takes at most one banking day, subject to the bank’s cut-off time; SEPA Instant transfers operate around the clock in seconds. The invoice follows the agreed acceptance process, and the due date follows the parties’ agreement.

Payment terms and late payment
Set the acceptance trigger and due date in the contract. If the parties do not agree a due date, payment is generally due once the other party has performed, and statutory default interest may begin on the following day.
For a B2B delay where the debtor is responsible, the statutory rate is the OeNB base rate that applied on 1 January or 1 July for the relevant half-year, plus 9.2 percentage points. The relevant base rate and delay interval are needed to calculate the interest amount. If the debtor is not responsible for the delay, the statutory fallback is 4% a year. Unless the contract provides otherwise, the creditor may also claim a €40 flat amount for collection costs.
What breaks, and at which step
Each stage has a different correction owner. Check the proposed status before signing, complete registration before work, then revisit conduct, invoices, SVS earnings and overdue debts as they arise.
| Step | Failure | Immediate correction owner |
|---|---|---|
| Before signature | The proposed label does not match a defined result, continuing service or employee-like control; a licensed activity is treated as though it needs no Gewerbeberechtigung. | Client and provider: compare the proposed conduct with the work model, then identify whether the provider is a licensed Gewerbetreibende or a Neue Selbständige. |
| Before work starts | A freier Dienstnehmer has not been registered for the applicable ASVG insurance. | Client: register with the competent health insurance carrier before work; at or below €551.10 monthly the pre-start duty still covers accident insurance. |
| During delivery | Actual directions, fixed hours or place, control and integration make the work employee-like. | Client and provider: reassess the relationship’s actual conduct rather than relying on the contract label. |
| At invoice | Required UID details or the VAT treatment are missing, or a small-business threshold has been crossed. | Provider: correct the invoice and reassess the relevant domestic or EU VAT condition; the recipient supplies its UID for a general-rule cross-border B2B service. |
| After tax assessment | A Neue Selbständige has crossed the €6,613.20 annual earnings threshold. | Provider: report the crossing to SVS within eight weeks of the tax assessment to avoid the 9.3% surcharge on health and pension contributions; back contributions can still be due. |
| After the due date | A B2B debt remains overdue. | Creditor and debtor: apply the agreed due date, then the responsibility-dependent statutory interest rule and, unless the contract differs, the €40 collection amount. |
The licensed-trader route has its own provider-side notification to SVS and the Gewerbebehörde, while the Neue Selbständige route turns on annual earnings rather than the client’s monthly ASVG registration. A construction-worker posting is a separate specialist route, not a general duty for independent contractor engagements.
What a mistake costs and who pays
A contract can allocate costs between the parties, but it does not transfer statutory duties by itself. The amounts below apply only to their stated triggers.
| Party | Risk | Amount or condition |
|---|---|---|
| Client in a freier Dienstvertrag | Missed pre-start ASVG registration or an arrangement whose actual conduct requires a different classification | The client owns the pre-start registration duty; the applicable consequences depend on the breach. |
| Neue Selbständige | Annual earnings exceed the GSVG threshold after tax assessment | Back insurance and provision contributions may be due; a 9.3% surcharge on health and pension contributions can be avoided by reporting the crossing within eight weeks of the tax assessment. |
| B2B debtor | Responsible late payment after the due date | OeNB base rate for the relevant half-year plus 9.2 percentage points; if the debtor is not responsible, 4% a year applies instead. |
| B2B debtor | Late payment where the contract does not set a different rule | The creditor may claim a €40 flat amount for collection costs in addition to default interest. |
| Client and provider | The real work does not match the contract label, or a provider’s licensed-trade and independent-registration duties are not addressed | The amount depends on the breach. Any contractual indemnity depends on the agreement and does not automatically transfer statutory liability. |
For free service, the client’s ASVG duty applies at or below €551.10 monthly for accident insurance, with broader insurance above the threshold. For a Neue Selbständige, compulsory GSVG insurance turns on annual earnings above €6,613.20, which is a separate test. A licensed Gewerbetreibende has separate provider-side notification duties and may seek a low-income insurance exemption only on the stated turnover, profit and eligibility conditions.
Models and when each fits
Choose the model from the actual work: a defined result, a continuing service with limited personal dependency, or employee-like personal dependency lead to different routes. The contract and record owner then follow that choice.
| Model | Decision trigger | Contract and records |
|---|---|---|
| Direct Werkvertrag | The provider owes a defined work or success and remains outside the client’s organisation. | Client and provider contract directly; the provider keeps the independent-business and invoice records for the engagement. |
| Freier Dienstvertrag | The relationship is a continuing service with absent or limited personal dependency and remuneration by time rather than result. | Client and provider contract directly; the client registers the free-service relationship with the competent health insurance carrier before work, at the scope set by the monthly threshold. |
| Licensed Gewerbetreibende or Neue Selbständige | The work is genuinely independent; the activity either needs a Gewerbeberechtigung or falls within the no-licence Neue Selbständige route. | Client and provider contract directly. The provider maintains the trade, tax and SVS records that apply to that route. |
| Contractor platform or Contractor-of-Record model | The services are genuinely independent; check whether the provider is the contractor’s contracting party. | The agreement determines who contracts with the contractor and keeps the engagement records. In a Contractor-of-Record model, the provider is the contracting party; other platform arrangements may differ. Neither model is an employment route. |
| Direct employment or an authorised employer of record | Personal dependency, including control, integration, assigned time or place, is present. | The employer or EOR holds the employment contract and employment records. See hiring in Austria and employer of record in Austria for those routes. |
A Contractor-of-Record model can reduce reclassification risk through its contracting role, but any indemnity depends on the agreement. Assess the actual work, including whether it creates a free-service relationship with client ASVG duties or independent work subject to the provider’s annual SVS test.
One contractor versus ten
Each added contractor needs a separate status and records review; headcount alone does not change legal status.
For each engagement, record:
- The form: a defined-result Werkvertrag, a continuing freier Dienstvertrag, or a route that should be treated as employment because the actual conduct shows personal dependency.
- The activity and registration path: whether a Gewerbeberechtigung is needed, or whether the provider is a Neue Selbständige; record the provider’s trade, tax and SVS actions where relevant.
- The actual work controls: who sets the time, place and work sequence, and whether the provider is integrated into the client’s organisation.
- The registration owner and pre-start date: for free service, the client’s ASVG registration; for independent work, the provider’s SVS position under the annual earnings test.
- The tax, UID and VAT status: the applicable small-business threshold, any U15 request, and whether a particular cross-border B2B service is subject to reverse charge.
- The contract and IP record: the agreed deliverable or continuing service, acceptance terms, intended licence and usage rights, and the current confidentiality and record-keeping terms.
- The invoice and due-date record: invoice fields, the agreed acceptance trigger and due date, plus a periodic check for changes in activity, control, insurance or VAT facts.
Review the record if the work becomes an ongoing controlled service or an insurance or VAT threshold is crossed. The client and provider remain responsible for their own steps.

Questions people actually ask
What qualifies someone as self-employed in Austria?
The contract label does not decide the status; the actual economic substance and conduct do. A defined work or success points to a Werkvertrag, while personal dependency through integration, set time or place, instructions and ongoing control points to employment.
Is a freier Dienstnehmer the same as a self-employed freelancer?
No. A freier Dienstvertrag is a continuing service relationship with absent or limited personal dependency and remuneration by time rather than by a completed result. A Neue Selbständige carries out a covered independent activity without a trade licence and has separate tax and SVS steps.
Who registers a free service contractor with Austrian social insurance?
The client registers a freier Dienstnehmer with the competent health insurance carrier before work starts. At or below €551.10 monthly in 2026, that registration covers accident insurance; above the threshold, it covers accident, health, pension and unemployment insurance.
Is €551.10 monthly or annual?
€551.10 is the 2026 monthly marginal-earnings limit for a freier Dienstvertrag: remuneration at that amount remains marginal for an individual relationship. It is different from the €6,613.20 annual GSVG insurance earnings threshold for a Neue Selbständige, so the two figures should not be substituted for one another.
Does an Austrian contractor need a trade licence?
It depends on the activity. A licensed Gewerbetreibende needs a Gewerbeberechtigung for the licensed Werkvertrag activity, while a Neue Selbständige carries out a covered activity without one. The provider, rather than the client, follows the relevant trade or self-employed registration route.
When does the Austrian small-business VAT exemption end?
An EU-established business must be at or below €55,000 in both the preceding and current calendar years. A current-year excess of no more than 10% keeps the exemption to year end but prevents it in the following year; above that tolerance, the crossing transaction and later transactions lose it. A non-Austrian EU business also has to meet the €100,000 EU-wide ceiling, for which there is no 10% tolerance.
What happens if an Austrian business pays late?
Where no due date is agreed, payment is generally due once the other party has performed. For a B2B delay where the debtor is responsible, statutory interest is the relevant half-year OeNB base rate plus 9.2 percentage points; otherwise the fallback is 4% a year. Unless the contract says otherwise, the creditor may also claim a €40 flat collection amount.
