Employer of Record in Serbia

Contents
General information, not legal or tax advice — confirm with a local adviser before you act.
In a Serbian employer of record arrangement, the local employing entity signs the employee’s contract, administers wages and performs the agreed employer tasks.
Temporary employment agencies receive permits valid for five years. An agency assignment requires a Serbian-registered user employer that actually supervises and directs the employee.
For an unregistered foreign company, establish the user’s identity and contractual role before relying on the arrangement. An EOR label or agency permit alone leaves that structure unresolved.
For genuinely independent services, 4dev.com is a contractor platform working with contractors in Serbia, separate from staff employment. Its Contractor Platform checks contractor documents and keeps contracts and closing documents together under one platform agreement.
What an employer of record does in Serbia
An employer of record is a provider whose employing entity signs the employee’s contract and administers employment, while a separate business agreement defines the services it provides.
Agency employment involves the worker’s employment contract and an agency–user assignment agreement covering work and remuneration. Any separate foreign-client agreement must fit those relationships.
The legal basis for an EOR arrangement in Serbia
An EOR arrangement must meet Serbia’s Agency Employment Law where the actual work and parties fall within temporary agency assignment.
Article 17 presumes an assignment when someone works for a user, or at its premises, under an employment or other work-engagement contract with a different employer, unless proved otherwise.
The employer and user bear responsibility for work contrary to the Act. Assess the actual working relationship against this presumption, whatever commercial description appears in the service agreement.
The user employer must be registered in Serbia
For a business hire, Article 2 recognises Serbian-registered legal persons and entrepreneurs, including registered branches or representative offices of foreign companies, as eligible user employers.
The agency must also have Serbian registration. The user must supervise and direct the assigned work, so the documents need to reflect who actually manages the employee.
Before signing, ask the provider to explain the legal basis for the registered user, actual supervision and any separate foreign customer’s role:
- Which registered party will be the statutory user employer?
- Who will actually supervise and direct the employee’s work?
- If your foreign company is unregistered in Serbia, where does it fit in those documents and working relationships?
Compare the provider’s proposed structure with the local employment, EOR and independent-contracting routes in the Serbia hiring guide.
Employment rights continue through an agency
The agency and user must give assigned employees equal working conditions with a comparable user employee, covering:
- Working hours, overtime and night work.
- Rest, annual leave and paid absence.
- The elements used to calculate wages, salary compensation and statutory expenses.
- Workplace health and safety.
- Pregnancy, breastfeeding and young-worker protection, and protection against discrimination.
The user supplies working conditions; the agency calculates and pays wages, compensation and expenses. The user’s applicable employment instruments determine the worker’s terms and the associated budget.
The statutory user is jointly and severally liable for the agency’s wage, salary-compensation and statutory expense obligations. The employee can enforce those monetary rights against the user as well as the agency.
Commercial indemnification terms may allocate exposure between the parties. They cannot remove the user’s statutory wage liability or the employee’s equal-treatment rights.
Check the employing entity and its agency permit
Check that the entity employing the worker holds a current Ministry of Labour agency permit. A global brand or local-partner claim does not establish the employing entity’s authority.
Use the Ministry’s temporary employment agency register, which is separate from its recruitment-agency lists. Match the employing company and permit records to the proposed contracts.
Request these documents and resolve any mismatch with the Ministry’s records before the assignment:
- Exact legal name and registered address of the employing entity.
- Company registration number and poreski identifikacioni broj (PIB, tax identification number).
- Ministry permit decision number and date, including any renewal decision.
- Permit start date and expiry date, and any withdrawal or cessation decision.
- Matching entity details in the employee’s employment contract and the agency–user assignment agreement.
The Agency Employment Law sets these permit and registration conditions:
| Permit validity | Five years | Ministry of Labour — Agency Employment Law |
| Renewal application | At least 30 days before expiry | Ministry of Labour — Agency Employment Law |
| Registered assignment activity | 78.20 — temporary employment agency activities; or 78.30 — other human-resource assignment | Ministry of Labour — Agency Employment Law |
| Activity and business-name registration application | Within eight days of receiving the permit; the business name must identify a temporary employment agency | Ministry of Labour — Agency Employment Law |
The authorised person signing employment and assignment contracts must hold the required higher-education qualification and pass the professional agency examination. The agency must also meet the prescribed premises and technical conditions.
The eight-day deadline concerns submitting the registration application after receiving the permit. Assignment activity cannot begin before the activity is registered, and registration requires the prior permit.
If the Ministry withdraws the permit, the agency cannot undertake new assignments. Employment contracts concluded beforehand remain in force until assignment expiry, capped at two months from the withdrawal date.
Who signs the employment and assignment documents
The agency signs an employment contract with the employee and an assignment agreement with the registered user. Any separate foreign-client contract needs review alongside those documents.
| Party | Document | Responsibility |
|---|---|---|
| Agency / employing entity | Employment contract with the worker; assignment agreement with the registered user | Employs the worker and calculates and pays wages, salary compensation and statutory expenses. |
| Employee | Employment contract with the agency; prescribed assignment information | Receives the agreed employment and assignment terms and a signed contract copy. For indefinite agency employment, the contract includes acceptance of work under assignment instructions. |
| Serbian-registered user employer | Assignment agreement with the agency | Supervises the work, supplies working conditions and payroll inputs, and retains statutory joint-and-several wage, compensation and expense liability. |
| Any separate foreign customer | Provider-specific service agreement, whose parties and terms need review | Request the proposed agreement and identify the customer’s contractual role. Its obligations depend on the actual terms; its customer status does not establish that it is the statutory user. |
Under the Agency Employment Law, agency employment can be indefinite or fixed-term for the assignment period. The proposed contract type determines how assignment-duration rules apply.
For indefinite employment, an assignment instruction forms part of the contract and replaces an annex. The worker must receive the prescribed fixed-term contract or indefinite-contract assignment instruction before assignment begins.
Conclude the written employment contract before work starts, with at least three signed copies, including one for the employee. Without the required contract, indefinite employment is deemed to start on the first working day.
Employment and assignment documents must describe the actual role and workplace, including:
- Employer and employee identity, required qualifications, job title and duties.
- Workplace, start date, employment type, and the legal basis and duration of any fixed term.
- Working-time category, daily and weekly hours, basic pay, remuneration elements and payment deadlines.
- The assignment’s user, its authorised representative, work location and annual-leave entitlement or method for determining it.
If permitted pay elements, payment deadlines or daily and weekly hours are incorporated by reference, the contract must identify the instrument setting them at signature.
The agency–user agreement records assignment headcount, period, fixed-term basis, location and work conditions. It also sets payroll-data delivery arrangements, identifies representatives and states agency remuneration and other agreed rights and obligations.
Remote and home-work contracts also need terms covering:
- Hours and supervision of the work and its quality.
- Employer equipment to be supplied, installed and maintained.
- Employee-owned equipment and reimbursement for its use.
- Other work costs and how they are determined, and other rights and obligations.
A service-level agreement may set administrative commitments. It cannot change statutory employee entitlements, the agency’s payment obligations or the user’s statutory responsibilities.
For software or databases created in employment duties, permanent exclusive economic rights normally belong to the employer, unless the contract provides otherwise. A different client needs a documented onward grant.
The diagram separates employment, assignment, customer-contract and software-rights checks. Its arrows do not validate a foreign-client structure or transfer rights automatically; the author’s moral rights remain untransferable.

Hiring through an EOR, step by step
Contracts, worker eligibility and individual insurance filing must be in place before work. The provider’s preparation schedule is separate from each statutory deadline.
| Step | Who acts and what to retain | Timing |
|---|---|---|
| Establish the employing structure | Provider identifies the employing entity, permit, registered user and fixed-term or indefinite employment type; retain the proposed contracting documents. | Agreed with provider |
| Set the employment package | Agency and user document the role, gross pay, equal-treatment comparator, entitlements and assignment costs; include remote-work arrangements where applicable. | Agreed with provider |
| Confirm worker eligibility | Employing entity checks eligibility and retains evidence, including the applicable foreign-national work and residence authorisation or exemption. | Complete before work; authorisation clocks depend on the route below |
| Conclude the documents | Agency and worker sign the employment contract; agency and user conclude the assignment agreement. Give the worker the prescribed contract or assignment instruction. | Employment contract before work; prescribed assignment information before assignment |
| File individual insurance registration | Agency or its authorised filer submits the worker’s unified registration to CROSO, the Central Register of Compulsory Social Insurance, using the contract as its basis. | Before the employee starts work |
| Retain the filing receipt | Filer downloads the worker-specific CROSO PDF; retain its submission date, time and registration number with the employment file. | Obtain the submission confirmation before work starts |
| Start the assignment | Worker begins the documented role once employment, filing and eligibility conditions have been addressed; user supplies the agreed working conditions. | Documented start date, subject to those conditions |
| Run the first payroll | Agency calculates and pays under the employment instruments; user supplies the required attendance and pay inputs. | Agreed payment deadline; at least monthly and no later than the end of the current month for the previous month |
The CROSO filer must have portal registration and a qualified electronic certificate. An authorised certificate holder or service agency may file for the employer; agree who files and supplies the receipt.
The CROSO PDF confirms receipt of the individual registration into the unified database. It proves filing and does not constitute substantive approval of the employment arrangement.
The three-working-day deadline covers insurance termination and changes during coverage. Initial employee registration is due before work, with no post-start grace period.
For an agency hire, retain the worker’s individual filing evidence with the employment documents. The Serbia hiring guide covers the full employer setup and first-day file.
Foreign-national hires add an authorisation stage
The employing entity must retain evidence of a foreign worker’s lawful stay and work eligibility before the start. Select the applicable route:
- An employment-based visa D, where applicable.
- A single permit covering residence and work.
- A statutory exemption supported by the person’s qualifying status and work right.
The Law on Employment of Foreigners sets these actual-employer conditions for the ordinary single-permit employment assessment:
- No redundancy dismissals in the relevant jobs during the 90 days before the single-permit application.
- Initiation of the labour-market test, whose request forms part of the electronic single-permit application.
- A proposed employment contract or another legally eligible work contract.
The employment service provides its labour-market-test report within four days after the test is initiated. Statutory exemptions require separate assessment; the government may exempt specified shortage categories or occupations from the test.
A single-permit application has a 15-day decision deadline running from submission of a properly completed request. The foreign national, employer acting for them or an authorised person may submit it.
A single permit may last up to three years, depending on the case’s reasons and supporting evidence. Match its granted duration to the employment and assignment documents.
During permit validity, a complete request to change employer or work basis, or add another employer, has a ten-day decision deadline. Where consent is required, the worker must obtain it before making that change.
The clocks have different triggers and cannot be added into an onboarding total. Agree the start date against outstanding documents, the applicable authorisation and the provider’s preparation commitments.
Payroll data, leave and working conditions during an assignment
The user must keep work and absence records and send the agency the previous month’s payroll data by the 15th; the agency remains responsible for calculating and paying the employee’s entitlements.
Under the Agency Employment Law, missing user data does not suspend the agency’s wage, compensation or expense payments. It must calculate from the information available to it, including the statutory average-hours basis where applicable.
Agree who records hours, absences and pay changes and how the user sends them to the agency. The user also supplies working conditions and workplace health and safety.
For workplace injury or occupational disease, the user owes damages to the assigned employee. The agency has subsidiary liability if the court-awarded damages cannot be recovered fully or partly from the user.
Hours and leave follow equal-treatment rules
Use the comparable user employee’s conditions and applicable employment instruments when planning schedules and leave and preparing payroll data:
- Normal full-time work is 40 hours weekly; a general act can set 36–40 hours with full employment rights.
- Weekly overtime cannot exceed eight hours, and total daily work including overtime cannot exceed 12 hours.
- Annual leave is at least 20 working days, with better entitlements possible under the applicable instruments.
Annual leave is usable after one month of uninterrupted work. In the employment start or end year, allow one twelfth per month worked. Sickness and non-working holidays do not consume leave days.
The holiday calendar includes weekend dates. Apply the following-working-day substitution for state holidays falling on Sunday and handle personal religious observances under their separate rules.
Send the agency qualifying hours for basic-pay supplements: at least 26% for overtime and at least 26% for night work, unless night work is already reflected in basic pay.
Work on a non-working holiday adds at least 110% of basic pay. Simultaneous supplement rights accumulate, so the holiday supplement may be only part of the calculation.
Maternity and subsequent childcare leave normally total 365 days, or two years for a third or subsequent child and specified multiple births. Account for the protected absence when planning assignment and employment end dates.
Pregnancy, maternity, childcare and special childcare leave prohibit dismissal and extend fixed-term employment through protected leave. Consult the Serbia hiring guide for the complete leave, holiday and working-time rules.
The agency's e-Bolovanje workflow
Agree who handles the agency’s e-Bolovanje (electronic sick-leave) access, absence records, calculations, funding and employee payments. Its process must match the actual employer category.
The e-Bolovanje – Poslodavac law phases employer access and additional claim functions:
- 1 January 2026: general application and the registration/access deadline for covered employers, subject to the entrepreneur exception.
- 1 April 2026: compensation-calculation requests and medical-commission objection and request functions apply.
- 1 January 2027: registration/access deadline for entrepreneurs employing at least one person; confirm whether the actual employing entity falls within that category.
For covered workers, the former sickness-certificate delivery duty and related Labour Law disciplinary dismissal ground cease to apply. Proceedings already begun before the new law applies finish under the previous rules.
Coverage excludes BIA personnel, professional military personnel and household-help employers. Apply the agency’s absence process within the law’s employer and worker scope.
Employer access to a diagnosis requires the insured person’s request and protective measures. Police officers have a separate provision. A foreign client has no automatic right to see the diagnosis.
Under the Health Insurance Law, incapacity reason and duration determine funding. The agency normally handles payment even when another body funds compensation:
| Absence | Funding | Agency administration |
|---|---|---|
| Ordinary illness or non-work injury | Employer funds the first 30 days; RFZO, the Republic Health Insurance Fund, funds from day 31 | First-30-day compensation is at least 65% of the preceding 12-month average salary, never below minimum wage. Agency normally pays the employee, including RFZO-funded amounts. |
| Occupational injury or disease | Employer funds throughout the incapacity while employment continues; RFZO takes over if employment ends during the entitlement | First-30-day compensation is 100% of that salary average, never below minimum wage. Keep this compensation separate from the user’s damages liability. |
| Qualifying voluntary organ, cell or tissue donation, or care of a sick child under three | RFZO funding starts on day one | Apply the relevant claim route; this exception changes the funding start, rather than creating the ordinary 30-day employer-funded period. |
For ordinary RFZO claims, the agency may advance compensation or request funds before paying. The handoff follows complete-documentation deadlines and a separate payment deadline after funds arrive.
RFZO pays entrepreneurs and their employees directly where the entrepreneur lacks a special account. Check whether this branch applies to the actual employing entity.
The family-support ministry pays maternity and childcare compensation directly to the beneficiary, with taxes and contributions funded from the national budget. These payments follow a separate route from the agency’s RFZO reimbursements.
The gross monthly maternity base sums salary contribution bases over the 18 months before the first maternity-leave month and divides by 18, subject to the statutory cap. Obtain the contribution history.
EOR costs: salary, contributions and service terms
An EOR quote includes employment obligations and commercial charges. Start with gross salary plus applicable employer contributions, then add entitlements, benefits and the provider’s service costs.
Salary, deductions and employer contributions
Gross salary includes employee salary tax and contributions; employer contributions add to the budget. Ask for a breakdown showing deductions, employer additions and the contribution base.
| Minimum labour price, from 1 January 2026 | RSD 371 net / hour | Government of Serbia — 2026 decision |
| PIT on salary | 10% | Personal Income Tax Law |
| Full-time salary PIT allowance per month, for payments from 1 January 2026 | RSD 34,221 | 2026 salary tax amendment |
| Employee pension and disability contribution | 14% | Contributions Law |
| Employee health contribution | 5.15% | Contributions Law |
| Employee unemployment contribution | 0.75% | Contributions Law |
| Employer contributions | 15.15% of the applicable base | Contributions Law |
| 2026 contribution floor per month | RSD 51,297 | Experta payroll parameters |
| 2026 contribution ceiling per month | RSD 732,820 | Published 2026 contribution ceiling |
The net hourly floor applies to hours actually worked. Grossing up requires salary tax and employee contributions, with statutory supplements and expenses payable separately.
The salary allowance reduces the income-tax base only. Contribution-base rules remain separate, and employee deductions must not be added again to gross salary.
For a part-time employee at one employer, pay below the monthly contribution floor attracts contributions on the full floor. Reduced hours therefore do not necessarily produce proportional contribution savings.
For multiple part-time employers, compare each salary payment with a floor proportional to working time. For contribution periods shorter than a month, use the applicable days-or-hours proportionate floor.
The full monthly ceiling still applies to shorter periods and part-time or reduced working time, subject to the Article 28 exception. Apply other statutory floor exceptions where relevant.
Annual personal income tax depends on the employee’s annual income and statutory deductions and reductions. Treat it as a separate individual assessment, rather than a standard monthly EOR employer surcharge.
A gross-budget example before the provider fee
The July 2026 information and communication industry mean illustrates a full-time ordinary-employment budget. Gross salary in this scenario exceeds the contribution floor and remains below the ceiling.
| Gross monthly salary at the industry mean | RSD 355,194.00 | Statistical Office |
| Agency-employer contributions | RSD 53,811.89 / month | Contributions Law — calculation |
| Monthly employment subtotal | RSD 409,005.89 / month | Contributions Law — calculation |
| Annualised employment subtotal | RSD 4,908,070.68 | Contributions Law — monthly scenario ×12 |
This industry mean does not price a particular role or seniority. Annualising repeats the monthly scenario twelve times; the result is a budget scenario rather than observed annual payroll.
The calculation excludes other employment entitlements, benefits and provider charges. Compare the agency’s itemised quote with the full payroll tables and three salary scenarios.
Statutory extras and service-contract items
Price statutory and agreed extras under the employment instruments, and provider services under the commercial agreement. Request the basis and amount of each item:
| Cost item | Legal or contractual basis | What to request in the quote |
|---|---|---|
| Pay supplements | Statutory minima and applicable employment instruments; qualifying overtime, night work, holiday work and employer service affect pay | Show qualifying hours and service, basic-pay reference and calculation, including simultaneous supplements. |
| Commuting, travel and field expenses | Statutory rights under the general act and contract; commuting applies where transport is not provided | State the applicable entitlement or provision arrangement, amount and reimbursement process. |
| Meals during work and annual-leave allowance | Statutory entitlements under the applicable instruments; meal entitlement applies if not otherwise provided | Identify the meal arrangement and annual-leave allowance outside the illustrated salary subtotal. |
| Bonus or extra salary | General act and employment contract; no fixed general statutory thirteenth salary | Identify any promised entitlement and when it becomes due. |
| Pay between assignments | Indefinite agency employees retain compensation of at least minimum wage between assignments, proportionate for part-time work | Explain how the agency funds this obligation and whether any client charge is specified by the service agreement. |
| Provider service remuneration | Agency–user agreement and actual commercial terms | Itemise the provider’s agreed charge and scope; no universal Serbian fee is established. |
| Any deposit | Actual service-contract terms | State whether it is required, its purpose, refund conditions and how unused amounts are reconciled; distinguish it from salary expenditure. |
| Setup, offboarding or permit-related charges | Provider-specific terms and any applicable administrative charge | Identify which charges apply, their basis and amount, rather than assume every provider charges them. |
| Invoice currency, conversion and service VAT | Actual invoice, contract and transaction-specific tax treatment | Explain the currency, any conversion method or cost, and VAT treatment for the proposed transaction. |
| Employment exit and service cancellation | Statutory employment settlement and separate commercial termination terms | Price applicable employee entitlements separately from any service cancellation fee; review ending an assignment. |
The agency may charge the user for services. It cannot charge the worker for assignment or subsequent employment with the user.
The example assumes no hiring-relief discount. Any claimed benefit needs the employing entity’s eligibility and the commercial treatment explained; charges, deposits and transaction terms depend on the actual agreement.
Changes to review before January 2027 payroll
A January 2027 quote must reflect adopted wage and tax changes from their effective dates, alongside the employing entity’s administrative deadlines.
- 1 January 2026: the wage-floor input is RSD 371 net / hour, and salary payments use a full-time monthly tax allowance of RSD 34,221.
- 1 January 2027: the adopted minimum labour price becomes RSD 405 net / hour for January–December 2027. The full-time monthly salary tax allowance changes to RSD 37,369.
- 1 January 2027: under the e-Bolovanje access rules, entrepreneurs employing at least one person reach their registration/access deadline. Establish the actual employing entity’s category; other covered employers had their deadline on 1 January 2026.
Confirm the 2027 contribution floor and ceiling before approving that year’s budget. The example uses 2026 parameters and cannot establish costs against unconfirmed new-year bases.
Review the complete employer calendar for Serbia with the agency when updating wage calculations and arranging access required for its employer category.
Hiring-relief eligibility and the client price
Hiring relief depends on the actual employing entity’s eligibility under tax and contribution rules. Whether it reduces the client invoice also depends on the commercial agreement.
From 1 January 2027, the income-tax amendment extends the end-year references in Articles 21v and 21d through 2028. The contribution amendment similarly extends the corresponding Articles 45 and 45v.
Specified revised conditions begin on 1 January 2028, separately from the extensions. Read the income-tax and contribution provisions together for these employer-level requirements and combined limits:
- A maximum relief period of 12 months after hiring the new employee.
- Net employee-headcount growth above the preceding 12-month average, subject to state-aid rules.
- Limits combining the same type of salary income-tax and contribution relief: 50% of the relevant salary costs and EUR 5.5 million per employer per year.
Extension alone establishes neither agency eligibility nor a client discount. Ask:
- Which employing entity would claim the relief, and under which provisions?
- Which commencement phase and eligibility conditions apply to the proposed hire?
- What employer and employee evidence supports that claim?
- Does the agreement pass any benefit into the client price, and how is that reflected in the quote?
Budget without an assumed discount until the employing entity’s entitlement and its effect on the client price are established.
Serbia’s assignment limits, tax exposure and software rights
Assignment type, user headcount and earlier work with the same user determine key limits. Permanent establishment, software rights and restrictive clauses need separate assessment.
Fixed-term headcount depends on the registered user
The fixed-term quota applies across agencies at the registered user. Switching providers creates no new capacity; the worker’s agency contract type determines whether the quota applies.
The Agency Employment Law measures the user’s total employee headcount when the assignment agreement is concluded, or when an amendment changes assigned headcount. These explicit brackets apply below 50 employees:
| Registered user: 2–9 employees | Maximum 1 fixed-term assigned worker | Ministry of Labour — Agency Employment Law |
| Registered user: 10–19 employees | Maximum 2 fixed-term assigned workers | Ministry of Labour — Agency Employment Law |
| Registered user: 20–29 employees | Maximum 3 fixed-term assigned workers | Ministry of Labour — Agency Employment Law |
| Registered user: 30–39 employees | Maximum 4 fixed-term assigned workers | Ministry of Labour — Agency Employment Law |
| Registered user: 40–49 employees | Maximum 5 fixed-term assigned workers | Ministry of Labour — Agency Employment Law |
At 50 or more user employees, apply the separate 10% ceiling to the total user headcount. Compare it with all fixed-term agency workers at the relevant agreement or amendment date.
No bracket states an allowance for users with zero or one employee. Neither interpolation nor an assumed percentage-rounding method supplies that missing entitlement.
Indefinite agency employees are excluded regardless of assignment length. The agency still owes their between-assignment wage compensation, which must remain in the employment budget.
The chart covers the five small-user brackets only. The 10% larger-user rule is separate; indefinite agency employees are excluded, and no larger-user capacity is calculated.

Count previous fixed-term work with the same user
The ordinary aggregate limit is 24 months with the same user. Count earlier direct fixed-term employment and fixed-term assignments through the current or other agencies.
Before an extension or provider change, obtain the worker’s history identifying the legal user, contract types, periods worked and claimed exceptions:
- Earlier direct fixed-term employment with that user.
- Earlier fixed-term agency assignments to that user, including through other agencies.
- The proposed assignment’s lawful fixed-term reason and duration.
- Documents supporting any longer-duration Labour Law exception.
Under the Labour Law’s fixed-term rules, breaks shorter than 30 days do not interrupt the clock. Neither a provider switch nor an arbitrary pause automatically resets counted service.
A fixed term requires an objective period, job or event. Longer employment needs a statutory exception with its own conditions and endpoint:
- An absent employee’s replacement: employment may run until that person returns.
- A project defined by duration: employment may run until the project finishes.
- A foreign national: employment may run through the work permit’s validity.
- A newly established employer registered within one year before the contract: up to 36 months in total.
- An unemployed person within five years of the old-age pension condition: until the condition is met.
Article 16 excludes indefinite agency employees from its duration and conversion rules. Their time-limited assignment instructions do not make the underlying employment fixed-term.
For covered fixed-term workers, breaching assignment rules or continuing for at least five working days after expiry deems indefinite employment with the user. The employee may seek a determination in a labour dispute.
The diagram checks agency contract type, same-user history and lawful exceptions before applying the ordinary limit. It gives no individual dates or remaining-time calculation.

Work that cannot be assigned
Specified jobs and replacement situations prohibit agency assignment. Remote work permission does not override those restrictions; the actual role and user circumstances determine whether they apply.
Article 13 bars assignment agreements in these cases. At signature, the user must tell the agency about relevant circumstances and any law or collective-agreement restriction:
- Replacing a striking employee, except where an employee designated to maintain the minimum work process during the strike refuses to work.
- Jobs the user has declared redundant during the period prescribed by the Labour Law.
- Assigning the employee onward to another agency.
- Jobs with statutory shortened working time under labour and safety rules, or enhanced pension-service credit under pension rules.
- National civil-service posts and civil-service posts in local government or an autonomous province.
- Cases where legislation requires the user to hold a public competition for fixed-term employment.
Law or collective agreements may impose other justified public-interest restrictions. Statutory shortened working time is a specific regime; that prohibition does not ban ordinary part-time work.
Permanent establishment depends on your local activity
An EOR does not resolve the foreign business’s permanent-establishment exposure. Assess actual Serbian activity and the applicable tax treaty alongside the employment structure.
The domestic Corporate Income Tax Law includes a fixed place through which a nonresident conducts business. A representative who has and exercises authority to conclude contracts in the nonresident’s name can also create a permanent establishment.
Stojković Attorneys’ cross-border employment analysis notes that an EOR does not automatically create a permanent establishment and that long-term, operationally integrated activity may warrant further tax analysis. The tax result still depends on the particular arrangement.
Assess where the business operates, employees’ actual duties and contract-signing authority under domestic law and the applicable treaty. The legal employer’s identity alone cannot settle that assessment.
How software rights reach the foreign client
A foreign client needs a documented grant from the rights holder. The employment default identifies the employer and does not directly give a different customer ownership.
Under the Copyright and Related Rights Law, the employer permanently holds all exclusive economic rights in computer programs or databases created in employment duties, unless the contract provides otherwise. Special remuneration applies if contractually provided.
Other duty-created copyright works have a different default: employer exploitation rights within its business for five years from completion, unless the general act or employment contract provides otherwise. The author retains the remaining rights.
For those other works, the author is entitled to special remuneration depending on exploitation effects; exclusive economic rights revert after the default period. The author’s moral rights cannot be transferred by contract.
The Serbia country guide explains employment defaults. For an agency hire, trace the worker–employer terms and each onward grant through providers or intermediaries to the intended client:
- Which deliverables are software or databases, and which are other copyright works?
- Do employment terms alter the applicable default, and does the employing entity hold the rights it proposes to grant?
- Which signed instrument grants rights to the client, through which entities, and for what uses and duration?
- What background or third-party materials are included, excluded or subject to separate permissions?
The client’s grant depends on the rights holder and the onward contracts. Inspect the agency–user agreement’s actual rights clauses; its existence alone does not give the client those rights.
On transferring or assigning software rights, Milica D. Čučković writes in her software-development agreement article:
it can only be done if the producer possesses such rights.
— Milica D. Čučković, Attorney, Čučković Legal
This is general software-contract guidance. It does not decide rights allocation in an EOR arrangement.
Non-compete terms need a paid basis
A post-employment non-compete needs an agreed employer payment and cannot last longer than two years; its validity also depends on qualifying knowledge or business access and an appropriate territorial scope.
The employment restriction requires conditions enabling access to particularly important technical knowledge, a broad circle of business partners, or important business information and secrets. The general act and employment contract define its territory according to the work.
Review the employment clause’s restricted activities, territory, duration and agreed monetary compensation together. A customer’s request to retain staff or prevent competitor work does not itself establish the Labour Law conditions.
Separately, terms in an employment contract, assignment agreement or other instrument that prohibit or prevent employment between the user and employee after assignment expiry have no legal effect under Article 15.
Ending an assignment or moving the employee to your entity
Commercial cancellation, assignment expiry and employment termination have separate consequences. The agency must determine the lawful employment outcome and settle the worker’s entitlements.
Assignment end and employment end are separate
An assignment-linked fixed-term contract may end with the assignment; indefinite agency employment continues. Establish the contract type and lawful exit basis before setting the worker’s final day.
Indefinite agency employees retain at least minimum-wage compensation between assignments, proportionate for part-time work. Customer cancellation neither removes that duty nor supplies a lawful dismissal ground.
The agency handles employment termination under the Agency Employment Law and applicable labour rules. Where the user reports conduct or performance issues, it must promptly give the agency written information and the evidence supporting them.
Apply the procedure for the actual departure reason. The customer’s commercial cancellation notice does not set the employee’s employment notice:
- Early probation termination: probation may be agreed for up to six months. Early termination requires at least five working days’ notice; the employer must explain its reason.
- Performance, knowledge or ability dismissal: give written deficiencies, instructions and a reasonable improvement period. Dismissal on this ground requires failure to improve. Notice is eight to 30 days under the general act or contract, depending on insurance service.
- Disciplinary or work-duty dismissal: a written warning must state the grounds, facts and evidence and allow at least eight days to respond. That response period is different from a notice period.
- Employee resignation: written notice at least 15 days before departure; the general act or contract can extend it, but not beyond 30 days.
- Redundancy dismissal: establish the lawful redundancy basis and pay the required severance before dismissal.
Pregnancy and protected maternity, childcare or special-childcare leave can bar dismissal and extend a fixed term. For complete procedures and payments by exit ground, see the Serbia employment guide.
The Labour Law’s redundancy minimum uses completed qualifying employment years with the legal employer and average monthly salary paid during the three months preceding the month of severance payment:
- Minimum severance = completed qualifying employer years × preceding-three-month average monthly paid salary ÷ 3.
Qualifying predecessor and related-employer service can count under the statutory rules; a period already covered by severance cannot count again. Time spent serving the same client is not automatically tenure with the agency employer.
Confirm qualifying service, applicable instruments and salary basis before calculating severance. Gross versus net remains unresolved here; the earlier industry-mean example cannot determine an employee’s award.
Pay outstanding salary, salary compensation and other earned entitlements within 30 days of employment ending. Redundancy severance remains due before dismissal.
Calculate unused-leave compensation separately using the previous 12-month average pay, proportionate to unused days. Obtain the leave balance alongside the severance calculation.
Moving to direct local employment
Moving to your Serbian entity needs new employment arrangements and an agreed agency exit. The service contract alone neither transfers the worker nor settles continuity.
The agency cannot charge the worker for assignment or subsequent employment with the user. Terms preventing user–worker employment after assignment expiry have no legal effect; agency–user service remuneration remains a separate contractual matter.
Agree the move with the agency, employee and new employer before setting its start date. Resolve:
- New employment contract, employing entity, duties, pay and start date.
- Worker agreement, the lawful end of agency employment and the final settlement.
- Benefits, leave and service continuity under the applicable documents and law.
- Commercial cancellation notice, any claimed service fee, deposits and refunds under the actual provider agreement.
- Insurance filings and any immigration authorisation required for the new employer.
For a foreign worker changing employer during a single permit’s validity, the employment-service decision is due within ten days of a complete request. Where required, obtain consent before the change; statutory exemptions need their own eligibility check.
Coordinate the old and new employers’ CROSO filings: employment end or insurance changes must be reported within three working days of the event. The new employee registration remains due before work starts.
Statutory liability and contract recourse
The agency and statutory user have different worker-facing liabilities and offence exposure. Commercial allocation of costs does not remove those statutory consequences.
| Party | Exposure | Statutory consequence |
|---|---|---|
| Agency and registered user | Unpaid salary, salary compensation and statutory expenses | The agency owes payment; the user has joint-and-several liability for those agency obligations. |
| Registered user; agency subsidiarily | Workplace injury or occupational disease | The user owes damages. Agency subsidiary liability applies if the employee cannot collect all or part of a court-awarded amount from the user. |
| Agency | Unlawful dismissal of an assigned worker | The employee may bring a labour dispute against the agency for remaining assignment wages, capped at 18 salaries, plus tax and contributions for that period. |
| Corporate agency | Listed agency offences, including unlicensed assignment, contract/quota/duration breaches or unpaid wages | RSD 800,000–1,500,000 under Article 35, according to the applicable offence. |
| Legal-person user | Listed user offences, including unlawful assignments, quota/duration, equal-treatment or payroll-record breaches | RSD 800,000–1,500,000 under Article 36, according to the applicable offence. |
| Agency | Assignment without a permit, or permit withdrawal under statutory conditions | Unlicensed assignment findings bar obtaining a permit for three years. Withdrawal bars new assignments; pre-existing contracts continue through assignment expiry, for at most two months after withdrawal. |
Each fine range belongs to its specified offences; the maxima are not a combined termination charge. Permit withdrawal has separate statutory grounds and does not follow automatically from a listed fine.
An indemnity may support contractual recourse, subject to its terms and enforceability. It cannot erase statutory worker claims or guarantee recovery. Commercial cancellation charges depend on the actual agreement.
When you do not need an employer of record in Serbia
Direct employment through your Serbian entity or genuinely independent services may meet the need without an EOR. Choose according to the actual relationship and employer arrangements.
You already have a Serbian employer
Your Serbian entity can remain the employer while outsourcing payroll or HR. Having no internal HR staff does not itself require an EOR.
An authorised CROSO service agency may file insurance records for your employer. Filing authority leaves your entity as the employer named in the employment contract.
Agree administrative tasks, record ownership, payroll review and retention of filing evidence. Compare direct employment, agency employment and independent services in the Serbia hiring-route comparison.
Direct employment by an unregistered foreign company
Work for foreign employers appears in Serbian labour and tax provisions, but those provisions alone do not supply an unregistered foreign company’s complete employer registration and payroll procedure.
The Labour Law’s territorial scope covers employees working in Serbia for domestic or foreign legal or natural persons. This defines worker protection, without establishing a particular nonresident employer filing mechanism.
Under the foreign-income tax rule, recipients of salary or other income in or from another country must calculate and pay Serbian tax themselves when the payer does not do so.
Employee self-assessment answers the tax-payment question in those circumstances. It leaves the unregistered nonresident’s employer, insurance-registration and employment-administration procedures unresolved.
The Foreign Investors Council’s 2025 White Book calls for clearer tax and labour regulation of people holding valid foreign-employer contracts under that employer’s jurisdiction.
Confirm the foreign company’s employer registration, insurance and payroll steps. Its employment contract and employee tax filing do not complete that procedure; the unresolved route does not establish a universal prohibition.
The work is genuinely independent
A genuine services engagement can use the appropriate contractor and tax form. One client or a remote workplace alone does not make an EOR necessary.
A Serbian entrepreneur is a registered natural person carrying on an activity for income. The entrepreneur tax independence test is a separate assessment for dealings with a principal or its related parties.
Stojković Attorneys explains that failure of the entrepreneur tax test does not automatically establish employment. Assess tax treatment and the real working relationship separately; a contractor label cannot settle either.
The Tax Administration’s freelancer regime covers eligible work or royalty receipts from qualifying non-withholding payers. It excludes employment and statutory temporary or occasional-work contracts, so it cannot simply replace the salary treatment of an employee.
The Serbia independent-contractor guide compares forms and independence criteria. Choose the agreement according to the services, actual relationship and applicable tax regime.
Alternatives to an employer of record in Serbia
Identify who signs the worker’s employment or services contract, what administration they undertake and which Serbian rules apply. Market labels do not determine those responsibilities.
| Arrangement | Legal employer or contracting party | When it fits | Serbia-specific check |
|---|---|---|---|
| Employment through your Serbian entity | Your entity signs the employee’s employment contract. | You intend to undertake local employer responsibilities and manage the employment relationship. | Plan ongoing payroll, insurance, working conditions and lawful exit administration, alongside entity setup. |
| Outsourced payroll or HR for your employer | Your employing entity remains the employer; the service provider performs agreed administrative tasks. | An existing employer needs help delivering its administration. | Define authorised tasks and records. A PEO market label does not establish a Serbian co-employment rule or exemption. |
| Licensed temporary employment agency arrangement | The agency employs the worker; a verified Serbian-registered user directs and supervises the assignment. | The actual work and parties fit the statutory agency framework. | Match the employer to its permit and identify the user and any foreign customer separately; apply assignment limits and user responsibilities. |
| Direct genuine contractor services | The customer contracts with the actual services provider, such as a registered entrepreneur or an eligible individual contractor. | The relationship supports independent services and the selected contracting form. | Assess employment status separately from entrepreneur tax independence and any freelancer-regime eligibility. |
| Contractor platform or COR arrangement | A COR contracts with the contractor. With a software platform, inspect whether the customer or an intermediary actually signs that agreement. | Genuine services need agreed contracting or administrative support. | Identify every counterparty and the actual indemnification terms; a platform label does not establish an intermediary contract or transfer liability. |
A payroll provider performs agreed administration for an employer. The glossary’s PEO comparison concerns a United States model and does not determine Serbian co-employment or statutory liability.
For an agency arrangement, identify the employing entity and its permit whether the provider owns it or uses a partner. Ownership alone does not establish which arrangement is better.
The Serbia country guide details your entity’s continuing responsibility for employment documents, insurance, pay, leave and lawful termination after setup.
A contractor of record signs the contractor agreement; inspect it alongside the customer contract. For software platforms, establish whether the customer or intermediary signs the services contract, or the platform only administers it.
Any liability allocation depends on enforceable indemnification terms. Check the covered obligations, exclusions and parties entitled to recourse before assuming exposure has moved.
Contracting support and indemnities do not establish independence. Apply the genuine-services criteria and form requirements in the Serbia contractor guide; an employment relationship cannot become independent services through indemnification.
How to choose a provider for a Serbian hire
Before agreeing a start date, the contract pack should identify the employer, statutory user, worker terms and commercial charges.
Read the employment contract, agency–user assignment agreement and client contract together. Their parties, duties and cross-references should also identify any partner in the chain.
The named employer should match the Ministry’s temporary employment agency register. The contracts also need to identify the statutory user, explain actual supervision and distinguish any foreign customer.
| Question | Document or answer to request | Why it changes the decision |
|---|---|---|
| Which legal entity will employ the worker, and under which permit? | Exact entity identifiers, Ministry decision, current validity and matching contract details. | Matches the employer to its permit; a direct/partner label is insufficient. |
| Who is the statutory user and who supervises the work? | User registration, assignment-agreement parties, actual reporting arrangements and the legal basis for any separate foreign-client role. | Checks parties and actual supervision against the registered-user framework. |
| Is agency employment fixed-term or indefinite? | Contract type; user-wide quota records; prior direct and all-agency fixed-term history with the same user; any exception documents. | Determines quota, duration and between-assignment compensation requirements. |
| What comparable conditions and payroll inputs apply? | Comparable pay and benefits, applicable instruments, and named owners of hours, leave, overtime and monthly attendance records. | Defines the package and user-to-agency data needed for payroll. |
| What worker-specific filing evidence will arrive before work? | Named authorised filer and CROSO PDF submission receipt showing the worker, submission time and filing number. | Proves the individual filing; it is not substantive employment approval. |
| What authorises a foreign worker to start or change employer? | Applicable eligibility route, application-completeness evidence, permit or required consent, and each statutory decision clock’s trigger. | Separates statutory decision periods from the provider’s start-date estimate. |
| How is the employment budget separated from the service price? | Gross pay, deductions within gross, employer contributions, statutory entitlements, agreed benefits and separate provider fees. | Exposes omissions and prevents adding employee deductions twice. |
| How do software rights reach the intended client? | Employment rights clauses, actual onward grant through each intermediary, covered deliverables, permitted uses and third-party or background-material exclusions. | Shows the client’s grant from the rights holder and through intermediaries. |
| Who handles sickness records and medical information? | e-Bolovanje responsibilities, access permissions, employee-request safeguards for any diagnosis access and the lawful information shared with the user/client. | Defines the absence workflow and lawful access to medical information. |
| How does an assignment end, or the worker move to the user? | Ground-specific employment procedure, settlement calculation, service cancellation terms and clauses addressing subsequent employment and worker charges. | Separates employment exit or transition from cancellation; identifies prohibited worker fees and hiring barriers. |
| What invoicing and deposit terms apply? | VAT treatment for the transaction, invoicing and settlement currencies, conversion method, deposits, refund conditions and additional charges. | Defines commercial commitments beyond the employment subtotal. |
| Who provides support, and what recourse is agreed? | Named contacts, service scope, escalation arrangements, cancellation obligations and indemnification clauses with their limitations. | Establishes actual support commitments and contractual recourse. |
Agree the provider’s support scope and transaction-specific invoice, currency, deposit, refund and cancellation terms. Do not assume universal service capabilities, certification or data-hosting requirements.
Resolve quote and contract discrepancies before relying on a start or transfer date. Retain the agreed responsibilities and individual worker records in the employment file.
Frequently asked questions
Is using an employer of record in Serbia legal?
The legal basis allows an agency arrangement that meets the applicable rules. It requires a permitted employing agency and a Serbian-registered user that actually supervises work; an EOR label alone leaves an unregistered foreign customer’s structure unresolved.
Can a foreign company hire in Serbia without opening a local entity?
An agency arrangement needs a registered user and an explanation of the foreign customer’s role. A complete operational registration/payroll route for direct nonresident employment remains unestablished here. Employee tax self-assessment does not supply it.
How much does an EOR in Serbia cost?
Combine employment obligations with the provider’s separate charges. The July 2026 ordinary full-time ICT industry mean scenario gives RSD 409,005.89 monthly before other entitlements and provider fees. It is a budget reference rather than an individual salary offer.
How long does EOR onboarding take in Serbia?
Contracts and CROSO filing must precede work. Where applicable, a single-permit decision is due within 15 days of a properly completed request. Total onboarding also depends on provider preparation and the applicable hiring stages.
Can an EOR arrange a Serbian work permit?
The employing entity or an authorised applicant may handle the application. The worker’s visa, single-permit or exemption route and actual employer eligibility determine the immigration steps. Obtain required authorisation before work.
Can an EOR employee work remotely in Serbia?
Remote work is possible with suitable employment and assignment terms. Specify supervision, hours, employer equipment, reimbursement for employee equipment and other costs in the contract documents. Equal working conditions and the registered-user requirement still apply.
Is there a limit on how many people I can hire through an EOR?
Fixed-term agency workers face user-wide quotas: a 10% ceiling at 50+ user employees and smaller-user brackets below that. No allowance is established for zero or one employee. Indefinite agency employees are excluded.
Can I move an EOR employee to my own Serbian entity later?
A move requires new employment arrangements. Blocking user–worker hiring after assignment expiry has no effect, and charging the worker for that hiring is prohibited. Review the transition documents and any required foreign-worker employer-change consent before starting.
