A foreign company can employ someone in Belgium without a Belgian subsidiary if it registers as an employer. An employer of record arrangement must fit Belgian rules on lending workers and employer authority; contracting works only where the person is genuinely independent. 4dev.com is a global contractor platform whose Contractor Platform works with contractors in Belgium.
Three ways to hire in Belgium
The route depends on who employs the worker and who controls the work. Direct employment requires Belgian employer registration; an employer of record must fit the worker-lending rules, while contracting requires genuine independence.
| Route | Legal employer | What you pay on top of salary | How you end it |
|---|---|---|---|
| Your own entity | Your Belgian entity, or your foreign company registered as an employer | 25% selected ordinary employer social security contribution on gross remuneration before reductions; other employer costs may apply | Employer dismissal: 1–52 weeks (Aug 2026+ hires) |
| Employer of record | The provider, where the arrangement is permitted | Arrangement-specific employment costs | Depends on the Belgian employment arrangement and contract |
| Contractor | No legal employer relationship where the contractor remains genuinely independent | The agreed contractor fee, subject to the actual working relationship | The contract terms, provided the relationship remains independent |
The 25% figure is the selected ordinary employer social security contribution for a for-profit private-sector employer before reductions, not an all-in employment cost. The notice entry covers employer dismissal of contracts executed from 1 August 2026; earlier start dates use earlier tables. An employer-of-record arrangement is conditional because hiring out workers where the client exercises employer authority is prohibited in principle outside limited exceptions. For contractors, the organisation of time and work and the possibility of hierarchical control matter more than the contract label.
The Belgian labour market
Statbel’s latest comparable survey of full-time employees covers 2022 gross monthly pay. The national mean is €4,076 / month (2022). Use it as a historical reference when planning an offer; the chief-executive figure compares broad occupations rather than software roles.

Set an offer against the role’s joint committee and classification. The applicable sectoral scale and the interprofessional guaranteed average minimum income govern the wage floor; neither is a market average.
Registering as an employer, step by step
A local or foreign first employer must complete Belgian employer registration before work begins. ONSS expressly provides for a foreign employer without a Belgian subsidiary; that employer still has to identify itself and complete the first-employment duties.
| Step | What happens | Takes |
|---|---|---|
| 1. Identify the employer | Use WIDE employer identification to obtain ONSS employer status; ONSS may allocate the Belgian enterprise number in its process | Varies |
| 2. Arrange work-accident insurance | Buy cover from an insurer admitted in Belgium; ONSS registration does not insure the worker | From the first employment day |
| 3. File DIMONA | Submit the immediate employment declaration for the first employee | Before work starts |
| 4. Submit DmfA | Report employee and remuneration data | Quarterly |
| Total | Complete the first-start steps, then continue DmfA reporting | Varies; no universal total duration is established |

Hiring and onboarding
Identify the joint committee and job class before making an offer; the sectoral scale may set the wage floor. Set the employment terms and complete required filings before work begins.
Contract and legal limits
For a fixed-term contract, state the end day, duration or event due on a known date. It normally has to be written separately for each worker by the start of employment; a generally binding sector collective agreement can exempt specified worker categories. Without the required written term, open-ended contract conditions apply.
A fixed-term contract ends at its agreed term without notice; if work continues after expiry, open-ended conditions apply in principle. Successive fixed-term contracts without a worker-attributable break are presumed open-ended unless justified by the nature of the work or another lawful reason. One statutory route permits up to four successive contracts of at least three months each within two years; another requires advance Labour Laws Inspectorate approval and allows contracts of at least six months each within three years.
For fixed-term contracts concluded since 1 January 2014, either party may give notice without serious cause in the first half of the term, up to six months, if the notice ends within that window. This option applies only to the first contract in a successive series; omitting the required notice calls for pay for the full or remaining notice period. After that window, early termination without serious cause requires remuneration through the agreed end, capped at twice the pay for the hypothetical open-ended notice period.
Probation in an ordinary employment contract: None. Student and temporary-agency contracts are the stated exceptions. A Belgian or foreign employer hiring a worker from outside the EEA or Switzerland for more than 90 days must apply for a single permit.
Before the first day
- Confirm the joint committee, job classification and applicable wage scale. JC 200 class A for a worker with zero experience is one sector-specific example, not a universal scale.
- Record the contract terms and applicable work rules.
- Arrange work-accident insurance with an insurer admitted in Belgium; ONSS registration alone does not insure the worker.
- File the DIMONA declaration before work starts.
- Apply for the single permit where the worker and duration meet the non-EEA/Swiss and more-than-90-days condition.
Minimum wage in Belgium: GMMI and sector scales
An offer must meet the applicable sectoral scale and the interprofessional guaranteed average minimum monthly income (GMMI). For workers aged 18 and over, the GMMI is €2,233.61 / month from 1 July 2026. Eligible yearly pay can count toward this average guarantee, so the figure is not a universal monthly base rate.
| Adult GMMI | €1,954.99 / month — from 1 December 2022 | National Labour Council: CBA amount table |
| Adult GMMI | €1,994.18 / month — from 1 November 2023 | National Labour Council: CBA amount table |
| Adult GMMI | €2,070.48 / month — from 1 May 2024 | National Labour Council: CBA amount table |
| Adult GMMI | €2,111.89 / month — from 1 February 2025 | National Labour Council: CBA amount table |
| Adult GMMI | €2,154.11 / month — from 1 January 2026 | National Labour Council: CBA amount table |
| Adult GMMI | €2,189.81 / month — from 1 April 2026 | National Labour Council: CBA amount table |
| Adult GMMI | €2,233.61 / month — from 1 July 2026 | National Labour Council: CBA amount table |
| JC 200 class A, zero experience | €2,242.80 monthly scale — 2026 sector sheet | FPS Employment: JC 200 posting |
The JC 200 class A figure applies to the named sector, class and experience level. Select the role’s joint committee and classification before fixing the offer.

Taxes and contributions
Gross pay, employee deductions and employer charges are separate calculations. For income year 2026, personal income tax uses 25–50% marginal rates; the 50% bracket starts above €51,070 of taxable income, and the basic tax-free amount is €11,180. The ordinary employee social security contribution is 13.07% of gross salary, subject to low-wage work-bonus relief.
For a for-profit private-sector employer, the selected ordinary employer social security contribution is 25% of gross remuneration before reductions. The 24.92% rate in the ONSS technical instructions is a different private-sector base presentation with a separately calculated wage-moderation component, so the two figures are not added together.
Reductions and separate charges can change the result: the technical tables include a 0.02% special work-accident contribution and a 0.01% asbestos-fund contribution in Q1–Q3 of 2026, while work-accident insurance is separately required. From 1 July 2026, the high-salary exemption applies only to covered base pay above €88,434 per quarter and remains subject to ONSS pay-code conditions; the category-1 structural reduction likewise uses the quarterly thresholds €11,687.74 and €9,738.14.
Selected employer costs at 2022 salary references
At each 2022 Statbel salary reference, the table adds the selected 25% ordinary contribution for a for-profit private-sector employer. The result is a partial base month, not a complete annual employment budget.
| National average, 2022 survey | €4,076.00 gross + €1,019.00 selected ordinary contribution = €5,095.00 partial monthly total | Statbel: wage overview; ONSS: contribution types |
| Brussels average, 2022 survey | €4,748.00 gross + €1,187.00 selected ordinary contribution = €5,935.00 partial monthly total | Statbel: wage overview; ONSS: contribution types |
| Chief executives, 2022 survey | €11,772.00 gross + €2,943.00 selected ordinary contribution = €14,715.00 partial monthly total | Statbel: wage overview; ONSS: contribution types |
These partial totals exclude sectoral bonuses, double holiday pay, insurance premiums, special and fund contributions, benefits and fees. The chief-executive pay point compares broad occupations rather than software roles. The quarterly high-salary rule cannot be applied as a monthly cap to these examples.

Working time and overtime
The general schedule is 38 effective hours a week, or 38 hours averaged over a reference period; sector rules can set a lower limit. Plan overtime against the applicable working-time rules rather than assuming one national premium or exception.
Since 1 April 2026, a part-time employee may perform voluntary overtime only for a temporary increase in work and after at least three years in part-time employment. Certain existing voluntary-overtime agreements retain their earlier treatment. The continuity and other conditions still apply; a full-time interval can interrupt qualification.
Since 1 June 2026, night work is permitted across sectors covered by the Labour Act, subject to the working-time, rest, remuneration, introduction-procedure and health safeguards that continue to apply. In distribution and related sectors, including e-commerce, the statutory night-premium rule generally starts at 23:00 for workers entering service from that date; workers already in service keep their earlier protected treatment. That change does not set a universal night-work premium for every sector.
Leave, sick pay and parental leave
After a full qualifying year, statutory annual leave is four weeks: 20 days on a five-day work schedule. Belgium also has 10 days of statutory public holidays per calendar year; a new worker can qualify for additional holidays after three months or 90 calendar days of activity in that calendar year.
For a full qualifying year, double holiday pay is 92% of gross monthly remuneration at the main holiday, calculated as 1/12 of that 92% for each qualifying month. This statutory double holiday pay sits outside ordinary social security contributions, but a special employee withholding applies.
For ordinary non-work illness or accident, a white-collar worker (bediende) hired indefinitely receives 100% of normal pay from the employer through days 1–30 without a seniority requirement. The same rule covers a fixed term of at least three months or an assignment normally expected to last at least three months. Manual workers and white-collar staff on shorter fixed terms or assignments have a one-month continuous-service condition and different guaranteed-pay rates after day 7. For a new incapacity starting from 1 January 2026 within eight weeks after the earlier incapacity that gave rise to guaranteed pay ended, a fresh full guarantee normally does not apply; unused guaranteed-pay days and a medically certified different illness or accident are exceptions.
For the first day of incapacity, the employer certificate exemption applies twice per calendar year; an employer with fewer than 50 workers on 1 January can derogate through a collective agreement or work rules. This is an employer-certificate rule and does not govern certificates sent to a mutuality.
A worker giving birth is entitled to 15 weeks of maternity leave for a single birth. Private-sector employees may fully suspend their contract for four months of parental leave; the four-month period can be split into separate months.
Why the joint committee changes the offer and budget
The joint committee and job classification determine which scale and conditional components belong in an offer. For JC 200 class A with zero experience, the 2026 sector sheet gives a €2,242.80 monthly scale; this is a sector-and-class example, not a universal Belgian rate. JC 200 scales were indexed by 2.21% in January 2026.
An eligible JC 200 employee receives a year-end bonus equal to one monthly wage, normally after at least six months of seniority at payment; eligibility and pro-rating still apply. The CBA also states a €250 base amount for its June annual bonus, subject to indexation and conditions, so that base amount is not a current indexed cash figure.
For the 2025–26 bargaining period, the discretionary wage-cost growth margin is 0%. Statutory indexation and pay-scale progression remain preserved, so an applicable scale may still require a change. Before quoting or budgeting, check:
- the joint committee, classification, scale and any sectoral bonus conditions;
- double holiday pay, including its qualifying-year condition;
- work-accident insurance, special and fund contributions, and benefits.
The selected base-month illustrations exclude those components and do not support an all-in annual total.
Termination: notice and payments
Employer notice depends on when execution of the employment contract began, not simply when it was signed. Use 1–52 weeks (Aug 2026+ hires) only for employer dismissal of contracts executed from 1 August 2026: notice is one week in the first six months of seniority and reaches a 52-week cap from 17 years.
Contracts whose execution began from 1 June to 31 July 2026 retain the earlier initial notice table, while gaining the 52-week cap from 17 years. Contracts begun before 1 June 2026 follow the pre-existing table. Worker resignation is separate: its notice period is capped at 13 weeks.
If an open-ended contract ends without full notice, the ordinary compensation basis is current remuneration for the notice period that should have been observed, or its remainder, including acquired benefits. The amount therefore depends on the applicable notice and remuneration rather than a universal exit-cost total.
Recent changes affecting Belgian employers
These enacted changes affect wage setting, absence, schedules and notice:
- 2025–26 bargaining period: the discretionary wage-cost growth margin is 0%, while statutory indexation and pay-scale progression remain preserved.
- 1 January 2026: the first-day employer certificate exemption for incapacity applies twice per calendar year. Employers with fewer than 50 workers on 1 January may derogate through a collective agreement or work rules; this concerns the employer certificate, not mutuality paperwork.
- January 2026: JC 200 wage scales were indexed by 2.21%. This is a sector-specific adjustment.
- 1 April 2026: part-time voluntary overtime is limited to a temporary increase in work after at least three years in part-time employment, subject to continuity and other conditions; certain existing agreements have grandfathering.
- 1 June 2026: night work is permitted in sectors covered by the Labour Act, while working-time, rest, remuneration, introduction and health safeguards remain. The 23:00 night-premium change concerns new starters in specified distribution and related sectors, including e-commerce; workers already in service retain their earlier protected treatment.
- 2026: the penny-index mechanism affects indexation on reference wages above €4,000 per month and adds a wage-moderation contribution tied to the saving; timing and terms depend on the relevant sector indexation.
- 1 July 2026: the adult GMMI became €2,233.61 / month. From the same date, the high-salary exemption applies only to covered base pay above €88,434 per quarter and subject to ONSS pay-code conditions.
- 1 August 2026: for employer dismissal of contracts whose execution starts from this date, notice is one week in the first six months and capped at 52 weeks from 17 years. Earlier execution dates follow the earlier tables described in the termination section.
What a mistake costs and who pays
The party responsible and the amount owed depend on the error. The table separates the documented obligations from sums that depend on pay, notice or an insurance policy.
| Party | Risk | Amount |
|---|---|---|
| Employer | No valid work-accident insurance; Fedris automatically affiliates the employer for the uninsured period | In 2026, the affiliation contribution is about €124.66 per worker per calendar month if uninsured for no more than three consecutive months, up to €297.74 after more than twelve consecutive months. Late payment adds 10% and interest. If an occupational accident is recognised while uninsured, Fedris recovers compensation paid in addition to the contribution; criminal prosecution is possible |
| Client user and lender | Prohibited hiring out where the client exercises employer authority | The client is presumed bound by an indefinite employment contract, and the client and lender are jointly liable for pay, benefits and social contributions; the amount depends on the sums due |
| Employer | Pay below the applicable guaranteed income or sectoral scale | The shortfall depends on the applicable scale. The adult GMMI is €2,233.61 / month from 1 July 2026, while JC 200 class A with zero experience is a €2,242.80 sector-specific example |
| Employer | Ending an open-ended contract without full notice | Compensation equals current remuneration for the notice period, or its remainder, including acquired benefits |
The presumed contract and joint liability arise in the prohibited hiring-out arrangement described above. The Belgium employer-of-record guide explains the conditions that distinguish a permissible structure from prohibited labour lending.
Questions people actually ask
Can a foreign company employ someone in Belgium without opening a subsidiary?
Yes: ONSS expressly contemplates a foreign employer without a Belgian subsidiary, but the employer still needs the WIDE identification route, DIMONA before work starts and quarterly DmfA reporting. Work-accident insurance must also be in place from the first employment day.
What is the minimum monthly wage in Belgium, and can a sector require more?
For workers aged 18 and over, the adult GMMI is €2,233.61 / month from 1 July 2026, but it is an average guarantee that can include eligible yearly pay. A sectoral scale can be higher: JC 200 class A for zero experience is a €2,242.80 monthly example, not a universal premium.
What is the average salary in Belgium in 2026?
The latest comparable Statbel full-time wage survey is for 2022, not 2026. It reports a national gross average of €4,076 per month, so it is a historical reference rather than a current offer or net-wage calculation.
Is a thirteenth salary compulsory in Belgium?
Whether a year-end payment applies depends on the applicable sectoral rules. Under JC 200, an eligible employee receives a bonus equal to one monthly wage and normally needs at least six months of seniority at payment; eligibility and pro-rating still apply.
How much does a Belgian employee cost above gross salary?
For a for-profit private-sector employer, the selected ordinary employer social security contribution is 25% of gross remuneration before reductions. At the 2022 Statbel national-average reference of €4,076.00 gross per month, that produces €1,019.00 of selected contribution and a €5,095.00 partial monthly total; sectoral bonuses, double holiday pay, insurance, special and fund contributions, benefits and fees are excluded.
Can an employer use probation in a Belgian employment contract?
No probation clause is valid in an ordinary employment contract concluded from 1 January 2014. Student and temporary-agency contracts are the stated exceptions.
How much notice does an employer owe for a new hire?
For employer dismissal of a contract whose execution starts on or after 1 August 2026, notice is one week during the first six months and caps at 52 weeks from 17 years of seniority. Contracts starting from 1 June to before 1 August 2026 use the earlier initial table with the 52-week cap, while worker resignation has a separate 13-week maximum.
Does a foreign hire need a single permit?
A Belgian or foreign employer hiring a worker from outside the EEA or Switzerland for more than 90 days must apply for a single permit. The applicable region and worker category affect the permit criteria and processing, so the rule does not establish a universal timetable.
