A foreign company can engage a Chilean specialist for genuinely independent services. If the work is personal, remunerated and performed under dependence and subordination, an employment contract is presumed regardless of its label. See Hiring in Chile for direct employment or the employer of record guide for that employee route. 4dev.com lists Chile as available through its Contractor Platform, a global contractor platform with standardized documents.

Where the line runs between employment and independent service in Chile

The working relationship determines status. Personal service for remuneration under dependence and subordination points to employment, whatever the contract or receipt says; a boleta de honorarios or a particular number of clients does not decide it alone.

What client control changes the answer?

For a Chile-based software specialist, agreeing a feature, acceptance criteria and delivery date describes the result the client has commissioned. The analysis changes if the client also fixes the specialist's daily schedule, supervises the work as it is performed, or requires compliance with instructions about how to carry it out: the Dirección del Trabajo's guidance identifies schedule, supervision and instructions as indicators of dependence or subordination. Those indicators do not create an automatic client-count, hours or tenure rule; their weight depends on the whole arrangement.

Use the same check before each engagement and when the working pattern changes:

  • Is the provider delivering an agreed result rather than working under the client's direction on how and when to perform it?
  • Do the day-to-day schedule, supervision and instructions match an independent services arrangement?
  • Do the contract, records and actual practice describe the same relationship?
A classification check tests personal service, remuneration and subordination; a schedule, supervision or instructions indicate employment risk despite a contractor label.
Personal service, remuneration and dependence or subordination can create an employment presumption regardless of the label. Contract wording does not displace the actual working relationship. Sources: 4.

Where contractor status breaks

Dependence and subordination can turn a labelled contractor engagement into employment. No verified universal client-count, hours, tenure or turnover threshold replaces that factual assessment. The other thresholds below govern registration, tax, coverage or documents.

Employment statusPersonal service, remuneration, dependence and subordination are assessed together; there is no universal numeric cutoff.Dirección del Trabajo: Subordination and dependence
Honorarios registrationA natural person who issues electronic honorarios receipts must start second-category activities; the issuer also needs SII tax access. This is a registration rule, not a status test.SII: Start of activities for honorarios receipts
2026 honorarios PPM15.25% from 1 January 2026. This is an income-tax advance, not a client cost or a status threshold.SII: Boleta de Honorarios 2026
Annual social coverageAt least five statutory monthly minimum incomes (IMM) of gross honorarios in 2025 triggers mandatory contributions through Operación Renta 2026, subject to the stated exceptions. The annual assessable income is 80% of prior-year gross honorarios; coverage runs from 1 July 2026 to 30 June 2027, and the stated partial-coverage option changes the coverage level. This is a coverage rule, not a status test.ChileAtiende: Honorarios contributions
Natural-person honorarios receiptThe VAT expansion for services did not change this receipt regime. This is a tax/document rule, not a status test.SII: VAT on services
Professional companyA professional company must be in the SII register and meet its requirements to avoid VAT. This is a tax/document rule, not a status test.SII: VAT on services
Service-export documentA Factura de Exportación applies when Aduanas qualifies the foreign-client service as an export. This is a document route, not a status test.SII: Export invoice

How a Chilean contractor registers

An individual who issues honorarios receipts starts second-category activities with the SII. A professional or service company follows its own registration and document route. In either case, registration does not settle whether the work is independent.

Natural person issuing honorarios receipts

A natural person carrying on a second-category professional or trade activity must start activities with the SII before issuing electronic honorarios receipts. The issuer also needs SII tax access through a Clave Tributaria or Clave Única; a foreign individual must have Chilean residence and a qualifying identity document. The SII's honorarios guidance sets out that route.

For a foreign client without Chilean domicile or residence, the Chilean issuer makes the PPM; the client does not withhold it. That allocation concerns the receipt and tax route, not the client's need to register as a Chilean employer.

Professional company or service company

A professional company must be registered in the SII professional-company register and meet its requirements to avoid VAT. A service company uses a Factura de Exportación only where Aduanas qualifies the foreign-client service as an export; a foreign client alone does not make every service eligible for that document. The client should check which issuer and document route applies to the engagement rather than treating an individual honorarios receipt, a professional-company document and an export factura as interchangeable.

What the Chile services contract must say

A Chile services contract should describe the independent work and the records that prove what was agreed, delivered and accepted. It should not use employment-style control terms where the arrangement is intended to remain independent.

Scope, independence, documents and IP

Set out the deliverables, acceptance criteria, due date and the provider's independence in performing the work. Allocate responsibility for the applicable tax and document route, then record confidentiality, data handling, the dispute path and how the parties confirm acceptance. These terms make the operational boundary clear, but they do not override the factual classification test.

For commissioned computer programs, Chilean law presumes that the author's rights are assigned to the commissioning party unless the parties agree otherwise in writing. That presumption is specific to commissioned software: it does not automatically cover designs, content, research or other deliverables. For those outputs, identify the author, the rights to be transferred, the scope of use and the written record of transfer; the author is the original copyright holder, while a transferee is a secondary holder under the statute.

Ending the service

The contract should state the notice process, what happens to unfinished work, the final acceptance step and the handover of agreed rights and materials. A genuine honorarios arrangement follows its service terms rather than ordinary Labour Code leave or service-indemnity rules, subject to the stated digital-platform exception. If the actual working relationship has become employment, use the Chile employment guide for the employment route rather than treating a services-contract exit clause as severance.

What invoice or receipt a Chilean contractor must produce for a foreign client

An individual on the honorarios route issues an electronic boleta. A professional company uses its applicable document, and a service company uses a Factura de Exportación only for a qualifying export. The client’s location alone does not turn every Chilean service into a factura.

Issuer / routeDocument and recipient fieldsTax/VAT branch
Natural person issuing honorariosElectronic boleta de honorarios. For a foreign recipient without Chilean domicile or residence, use RUT 44.444.446-0 and the foreign client's name. Issue it when the professional service is paid and no later than 90 days after payment; the receipt is in CLP, with a foreign-currency equivalent allowed in its detail field. The issuer makes the PPM; the foreign client does not withhold it. The VAT expansion did not change the natural-person honorarios receipt regime.
Registered professional companyUse the company's applicable document route; it is not an individual honorarios receipt.A VAT exemption applies only where the company is in the SII professional-company register and meets its requirements.
Service company with a qualifying export serviceFactura de Exportación only when Aduanas qualifies the foreign-client service as an export.Qualification is a separate export-document condition, not a universal foreign-client or VAT-turnover rule.
A Chilean service provider follows separate branches for a natural-person honorarios receipt, a qualifying professional-company document or a qualifying export factura.
A natural-person boleta uses the foreign-recipient RUT and is issued in CLP on payment or within 90 days. Professional-company and export-factura routes have separate eligibility conditions. Sources: 8, 9, 10, 11, 12.

How the money arrives for a Chilean contractor

A services contract can state its currency, while an honorarios boleta remains a CLP document and the credit to a Chilean bank account is a separate banking step. The document rule does not prescribe one receiving rail, exchange rate or allocation of bank and correspondent charges.

BancoEstado provides one documented route: its customers can receive an incoming foreign order into a CuentaRUT, current account, electronic cheque account or savings account; ChileAtiende separately lists domestic transfers to CuentaRUT and other BancoEstado accounts. For the foreign order, the sender provides the beneficiary and account details plus BancoEstado's SWIFT address; its incoming-order guidance says to check charges with the correspondent bank. The parties should therefore settle the currency and any provider-specific conversion or charge allocation in their agreement rather than assume a universal Chilean rule.

For an honorarios boleta to a foreign client without Chilean domicile or residence, the Chilean issuer makes the monthly PPM and the client does not withhold it. In a hypothetical 2026 CLP 1,000,000 honorario, the issuer-side PPM advance is CLP 152,500 and CLP 847,500 remains after reserving that advance only. Those amounts are not final net income: they exclude final tax settlement, social insurance and other costs, and the current-year PPM must not be conflated with the separate Operación Renta 2026 assessment based on 2025 receipts.

Payment terms and late payment in Chile

For an honorarios engagement, record the due date, acceptance step, dispute process and supporting records in the services contract; the statutory factura rule does not automatically supply those terms. Ley 21.131 provides a distinct regime for a qualifying factura.

Document routeDue-date ruleWhat follows a delay
Boleta de honorariosUse the agreed due date, acceptance and dispute terms in the services contract. No verified rule extends Ley 21.131's 30-day deadline, statutory interest or 1% recovery commission automatically to a boleta.
Qualifying facturaLey 21.131 sets a 30-calendar-day maximum from receipt of the factura. A longer exceptional term requires a qualifying written, registered agreement.Statutory current interest accrues from the first day of delay, and the debtor owes a fixed recovery commission of 1% of the unpaid balance.

What breaks between signing and annual tax settlement

Classification, receipt issuance, monthly tax advances and annual coverage have different triggers. Check each at its own stage, from the working arrangement through Operación Renta.

StageWhat breaksWhat to check
Working arrangementThe services label masks personal service for remuneration under dependence and subordination.Test the actual relationship; an employment contract can be presumed despite the label.
SII registrationA natural-person issuer has not started second-category activities.Register before issuing an electronic honorarios receipt.
Foreign-recipient detailsThe boleta carries the wrong recipient identification. For a foreign recipient without Chilean domicile or residence, use RUT 44.444.446-0 and the recipient's name.
Receipt timingThe boleta is not issued at payment or within the permitted period.Issue it when the service is paid and no later than 90 days afterwards.
Monthly PPMThe client is treated as the withholding party for a foreign-client boleta. The Chilean issuer makes the 2026 monthly PPM; the foreign client does not withhold it.
VAT or export documentA natural-person boleta, professional-company document and export factura are treated as the same route.Check the issuer and eligibility: the natural-person regime is unchanged, the professional-company VAT position is conditional, and an export factura needs Aduanas qualification.
Acceptance and IPThe parties cannot show accepted work or the intended rights position.Keep acceptance records and contractual IP terms; the commissioned-software presumption does not cover every deliverable.
Annual coverageA current-year receipt or monthly PPM is used as though it were the annual social-insurance assessment.Operación Renta 2026 uses 2025 gross honorarios. The five-IMM trigger and exceptions apply; SII calculates contributions on the stated 80% base, Treasury pays the institutions, and coverage runs from 1 July 2026 to 30 June 2027.
For a hypothetical CLP 1,000,000 foreign-client honorario, the Chilean issuer pays CLP 152,500 in monthly PPM and CLP 847,500 remains before final tax and other costs.
2026 example only: issuer PPM is 15.25%, or CLP 152,500 on a hypothetical CLP 1,000,000 honorario. CLP 847,500 remains before final tax, social insurance and other costs. Sources: 6, 15.

Operación Renta 2026 begins with 2025 receipts. The five-IMM trigger and exceptions determine whether mandatory contributions apply; choosing partial coverage reduces health and pension coverage.

2025 gross honorarios are assessed in Operación Renta 2026; if the five-IMM threshold and other conditions apply, SII calculates contributions, Treasury pays institutions and coverage runs from July 2026 to June 2027, with a partial-coverage option.
Separate from 2026 monthly PPM: Operación Renta 2026 uses 2025 gross honorarios. Mandatory contributions are subject to the five-IMM threshold and exceptions; partial coverage reduces health and pension coverage. Sources: 7.

What a classification or document mistake costs, and who pays

The responsible party and amount depend on the missed obligation. The cited rules establish no single misclassification fine or fixed contractor penalty.

Chilean honorarios issuerTreats the foreign client as the withholding party or omits the issuer's tax and annual steps. The issuer makes the 2026 15.25% monthly PPM and files the annual Form 22; annual coverage uses the separate prior-year receipt test and is subject to its conditions. No fixed penalty is evidenced here.

Models and when each fits in Chile

Choose an independent-services model only where the actual work remains independent; repeated supervised staff work belongs on an employment route. The model changes the contracting party and documents, but it does not replace Chile's factual test for dependence and subordination.

ModelWho signsWho directs workDocumentsBest fit
Direct contractorClient and the individual honorarios issuer. The provider controls how and when the agreed service is performed.Services contract, acceptance record and the applicable boleta.A defined, genuinely independent service.
Registered businessClient and the contractor's company. The company delivers the agreed service; actual day-to-day control still matters.Corporate route and the applicable company document.A provider operating through a registered business.
Contractor-of-Record categoryThe provider is the contracting party with the contractor under its own model. The engagement must still remain independent in practice. The provider's contract and documented workflow.A contractor engagement needing a contracting-party model; liability allocation depends on the indemnification terms, not the category label.
Own Chile employerThe Chile employer and the employee. The employer directs employment.Employment contract and employer records.A continuing supervised role.
Employer of recordThe employer of record and the employee, under the provider arrangement. The work is an employee route, not an independent-services classification.Employment and provider documents.A role that should be engaged as employment without the client using its own Chile employer.

In a Contractor-of-Record arrangement, the provider contracts with the contractor. The work must remain independent in practice; any indemnification between the parties depends on the contract clause.

When an independent project becomes a continuing role with supervision, schedule control or instructions on how the work is done, reassess it as employment. The Chile employment guide covers direct employment, and the employer of record guide covers the employee route through that model.

What changes between one contractor and ten

Ten contractors create no separate Chilean legal category. They require the same status, document and rights checks as one engagement, repeated for each person.

For every contractor, keep a record of:

  • the service scope, deliverables and acceptance record;
  • the actual working pattern, including whether the provider controls schedule and method;
  • the issuer's SII status and the document route that applies;
  • foreign-recipient fields where an honorarios boleta is issued to a client without Chilean domicile or residence;
  • the boleta or other applicable document, the issuer-side PPM, and the separate annual tax and social-coverage assessment where they apply;
  • the agreed IP position and the record of rights transfer or handover; and
  • a periodic classification review when a project becomes a continuing supervised role.

Review each role when a project becomes continuing work with a fixed schedule, supervision or instructions. A shared contract label cannot settle classification for the whole roster.

Questions people actually ask

Can a foreign company hire an independent contractor in Chile without an entity?

Yes, where the service is genuinely independent and the actual relationship does not show dependence and subordination. A foreign client without Chilean domicile or residence can be named on an honorarios boleta under the SII's foreign-client route; that document route does not convert a dependent relationship into independent services.

What makes a contractor an employee in Chile?

Personal service for remuneration under dependence and subordination points to employment, and an employment contract can be presumed despite the label the parties use. A schedule, supervision and instructions are indicators assessed with the whole relationship, not standalone numeric tests.

Boleta or factura for a foreign client?

A natural person on the honorarios route issues an electronic boleta, while a professional company and a service company can follow separate document routes. A Factura de Exportación applies only when Aduanas qualifies the foreign-client service as an export; no universal VAT-turnover rule is established for every foreign service.

Does a foreign customer withhold from a Chilean honorarios receipt?

For a foreign client without Chilean domicile or residence, the Chilean issuer makes the PPM and the client does not withhold it. The issuer uses the foreign-recipient RUT 44.444.446-0 and the foreign client's name on the boleta.

Can a boleta show dollars?

An honorarios boleta must be issued in CLP. The detail field may state a foreign-currency equivalent, but it does not change the receipt's CLP denomination.

When does honorarios social coverage begin?

Operación Renta 2026 uses 2025 gross honorarios: the five-IMM threshold and stated exceptions determine whether mandatory contributions apply. Where that path applies, coverage runs from 1 July 2026 to 30 June 2027; the partial-coverage option reduces health and pension coverage.

Does the 30-day factura rule apply to boletas?

Ley 21.131 sets a 30-calendar-day maximum from receipt for a qualifying factura, with a longer exceptional term only through a qualifying written, registered agreement. The 30-day deadline, statutory interest and 1% recovery commission have not been established for a boleta de honorarios.

Who owns commissioned software?

For software produced on commission, Chilean law presumes the author's rights are assigned to the commissioning party unless the parties agree otherwise in writing. That presumption is specific to commissioned software; for other deliverables, record the intended rights transfer in writing because the author is the original copyright holder.
