Hiring contractors in Turkey

General information, not legal or tax advice — confirm with a local adviser before you act.
A foreign company can commission genuinely independent services in Turkey. If the person works dependently for wages, the relationship may be employment regardless of the agreement's label or tax document; the Turkey country guide covers direct employment and the employer of record guide covers a provider route. For independent engagements, 4dev.com's Contractor Platform works with contractors in Turkey.
Employee vs contractor: where Turkey draws the line
Turkey's Labour Law treats dependent work for wages as employment. Articles 2 and 8 identify the worker, employer and employment relationship through the employment contract. A services label, tax registration or invoice cannot settle whether the work is dependent.
Social insurance follows the same underlying status: SGK 4/1(a) covers employees, while 4/1(b) covers people earning taxable commercial or professional income independently in their own name and account. Check how the person works before applying the registration and document rules below.
What dependence looks like in practice
Review who controls the work and whether the person is integrated into the client's operation, alongside their freedom to decline assignments and to work on their own account. Those are practical signs to assess against the real arrangement, rather than a statutory points test that settles status from a contract term or an administrative document.
An independent contractor can, however, still be considered to be a de facto employee
— Beril Yayla Sapan and Asena Aytuğ Keser, Partners, Gün + Partners
Compare the agreement with how the client actually directs and organises the work. The 4/1(a) or 4/1(b) route follows that assessment, not the label on a form.

Where contractor status breaks
Registration and electronic-document deadlines depend on the person's tax route. None of them determines whether the work is independent.
Registration and document deadlines
| Independent professional starts activity | Notify the tax office within 10 days, including through Dijital Vergi Dairesi | GİB professional-income guide |
| Professional who must use Defter-Beyan | Apply by the end of the seventh business day after filing the start notice | GİB professional-income guide |
| Newly starting professional | Apply for e-Serbest Meslek Makbuzu by the end of the third month following the starting month | GİB professional-income guide |
| Required fatura outside the e-Arşiv application | From 1 January 2026, generally issue it as e-Arşiv regardless of amount, subject to the communiqué's exceptions | GİB e-Document General Communiqué 509 |
| Required fatura from named basit usul or işletme hesabı esası taxpayers | Tax-inclusive TRY 3,000 e-Arşiv format trigger through 31 December 2026; from 1 January 2027, the amount trigger ends | GİB e-Document General Communiqué 509 |
The professional deadlines apply only to that route, with Defter-Beyan required where applicable; a commercial trader's registration path may differ. The e-Arşiv amounts govern the format of a required fatura, not whether every transaction needs one. They do not replace the professional receipt or create a single-client, hours or turnover safe harbour for contractor status.
How a contractor is registered in Turkey
Ask which tax and SGK status applies before collecting registration evidence. A professional, a commercial trader and an employee do not follow the same document path.
Independent professional, trader or employee
An independent professional must notify the tax office of the start of activity within 10 days, including through Dijital Vergi Dairesi. A professional who must use Defter-Beyan applies by the end of the seventh business day after filing that start notice.
SGK places a person working under an employment contract in 4/1(a). A person earning taxable commercial or professional income independently in their own name and account falls within 4/1(b), as set out in SGK's status guidance. A commercial trader's registration and document route depends on that trader's status, so the professional notification and Defter-Beyan sequence does not describe every contractor.
Tax and SGK responsibility
For 2026 non-wage taxable income, the progressive rates are 15% up to TRY 190,000, 20% from TRY 190,000 to TRY 400,000, 27% from TRY 400,000 to TRY 1,000,000, 35% from TRY 1,000,000 to TRY 5,300,000, and 40% above TRY 5,300,000. These bands apply to taxable income; they are not rates on a client's gross service bill.
For a 4/1(b) independent worker, the 2026 minimum monthly premium is TRY 11,808.23. It is TRY 10,156.73 where the five-point incentive for regular premium payment applies; voluntary insured persons and village or neighbourhood heads are excluded from that incentive. The monthly premium is due by the end of the following month, under SGK's 2026 independent-worker guidance.
These income-tax and 4/1(b) obligations belong to the qualifying independent worker. Commissioning services does not, by itself, shift them to every client, and the figures do not set a foreign-client withholding rate.
What the Turkish contractor agreement must say
The agreement should record what the contractor will deliver, how the client accepts it and which economic rights the client receives. Its terms must match a genuinely independent working arrangement.
Scope, acceptance and IP rights
Set out the deliverables, any change-request process, who records acceptance, the document the contractor will issue, the due-date trigger and the agreed allocation of currency and related charges. These terms create a record of the work and its acceptance. They are drafting choices, not a substitute for assessing the actual relationship.
Where the client needs an assignment or licence of economic rights, Turkish intellectual-property guidance requires it to be in writing and to specify each transferred or licensed right separately. A broad work-for-hire phrase does not supply that specification.
The agreement can identify its governing law and dispute forum, but those choices must be assessed for the actual parties and engagement. A foreign-law or foreign-forum clause cannot be treated as a universal answer for a Turkey-based service relationship.
Ending the contract
Set the contractual exit process, treatment of accepted work, handover of the agreed deliverables and the records that close the engagement. For independent services, contractual exit terms govern; employee notice rules do not apply simply because the parties call the document a contractor agreement. If the work is dependent in practice, see the Turkey country guide for statutory termination rules.
Which invoice or receipt a Turkish contractor produces
An independent professional issues a receipt for each collection; a trader issuing a required fatura follows a different document route. Test VAT separately against the service and where it is used.
| Status | Document and timing | VAT question |
|---|---|---|
| Independent professional | Issue a serbest meslek makbuzu for each collection; apply for e-SMM by the end of the third month after the starting month | Apply the VAT test separately from the receipt route |
| Trader issuing a required fatura | From 1 January 2026, e-Arşiv generally applies regardless of amount, subject to the stated exceptions; named categories retain a tax-inclusive TRY 3,000 format trigger through 31 December 2026 | Apply the VAT test separately from the fatura route |
Professional receipt at collection
An independent professional issues a serbest meslek makbuzu for each professional collection and gives a copy to the customer. The receipt must show the issuer's name or title, address, tax office and account number; the customer's name or title and address; the amount collected; the collection date; and the professional's signature. e-Serbest Meslek Makbuzu has its own application deadline: the end of the third month following the month in which the activity began.
When a fatura must be electronic
The fatura route is distinct from the professional receipt. From 1 January 2026, a taxpayer outside the e-Arşiv application generally issues a required fatura as e-Arşiv regardless of amount, subject to the exceptions in GİB's e-Document General Communiqué 509. Separate e-Fatura users follow their own route.
For basit usul commercial-income taxpayers and işletme hesabı esası bookkeepers issuing a required fatura, the tax-inclusive TRY 3,000 trigger remains through 31 December 2026. From 1 January 2027, that amount trigger ends. This concerns the format of a required fatura; it does not decide whether an invoice is required in the first place.
VAT and service exports
For taxable supplies and services outside the reduced-rate lists, the general VAT rate is 20%. Under GİB's VAT General Application Communiqué, a service qualifies for the Turkish VAT export exemption only when the customer is abroad and the service is used abroad; a foreign customer or overseas billing on its own does not complete the test.
A professional receipt or e-Arşiv fatura records a transaction; neither determines its VAT treatment. A foreign customer alone also fails the export-use test.

How money reaches a contractor in Turkey
The available transfer route depends on the parties, the currency terms and the bank. Keep the service record and tax document aligned with the transaction.
Currency and local rails
EFT is Turkey's domestic interbank system for Turkish-lira transactions. FAST has a per-transfer limit of TRY 300,000 from 26 August 2026, as set out in the Central Bank announcement. That is a domestic rail limit, not an invoice cap or a promise about an international transfer.
For a service contract between two Turkish residents, the currency-protection communiqué generally restricts foreign-currency or FX-indexed pricing, subject to listed exceptions that include export and foreign-currency-earning services. That resident-pair rule does not automatically describe a contract with a non-resident foreign client.
Before the transaction, match the payer and contractor details to the agreement, accepted work and the relevant receipt or fatura. Confirm the available route, account instructions, conversion and charge allocation with the bank and the contract for that transaction. The bank and contract determine timing and charge allocation for the particular cross-border transaction.
Payment terms and late payment
Article 1530 applies to covered supply transactions between commercial enterprises under the applicable contract law. Establish that scope before using its deadlines or remedies.
When Article 1530 applies
For a covered supply, a creditor that has performed its supply obligation can rely on an agreed due date or payment period: a debtor that does not pay then is in default without a demand, subject to the statutory qualifications. The official text of Article 1530 does not make every freelancer invoice or foreign-law contract a covered commercial-enterprise supply.
If there is no valid payment period, default normally follows 30 days after the debtor receives the invoice or equivalent payment request. The statute provides alternatives where the receipt date is unknown or delivery, review or acceptance affects the trigger, so the agreement should preserve the relevant acceptance record.
An agreed period is ordinarily limited to 60 days. A longer period needs express agreement and must not be grossly unfair to the creditor; the 60-day cap is absolute where the creditor is an SME or an agricultural or livestock producer, or where the debtor is a large enterprise.
What follows a missed due date
For a covered commercial-supply debt with no valid contractual default-interest rate, the 2026 statutory rate is 43% annually. The 2026 minimum recovery-cost compensation for those covered debts is TRY 2,020, according to the Central Bank's Article 1530 rates.
Before applying either figure, check the covered transaction, the due date, acceptance record and whether a valid contractual default-interest rate already applies. Neither figure is a general remedy for every contractor engagement.
What breaks between agreement and settled work
The most consequential errors occur when one document is used to answer a different question: an invoice cannot establish independence, and an overseas address cannot establish VAT export treatment. Check each decision at the step where it arises.
| Step | Failure | Repair/check |
|---|---|---|
| Working relationship | A services agreement, tax registration or receipt is treated as proof of independent status | Test the actual relationship for dependence before using the contractor route |
| Status and document route | The professional notice and e-SMM route are applied to every contractor, or a required fatura is confused with a professional receipt | Identify professional or commercial status first; then match the document and e-document rule to that route |
| Economic rights | A broad clause purports to cover all intellectual-property rights | Use a written assignment or licence that specifies each economic right separately |
| VAT export | A foreign customer or overseas billing is treated as sufficient | Test both a foreign customer and use of the service abroad |
| Currency | A resident-to-resident foreign-currency rule is applied without identifying the parties or exceptions | Identify the parties' residence and test the stated service-contract exceptions |
| Acceptance and late payment | An invoice is sent without a clear acceptance record, or Article 1530 is assumed to apply | Keep the agreed scope, approval and due-date record; establish covered commercial-enterprise supply and the actual contract law before applying the statutory remedies |
Keep the underlying agreement, acceptance evidence and relevant documents with these checks. A corrected form alone will not change the actual working relationship or bring an uncovered debt within Article 1530.

What a classification mistake costs and who pays
Costs depend on the actual relationship and the specific statutory breach. Turkey does not set one universal fine for every disputed contractor classification.
| Party | Risk | Amount |
|---|---|---|
| Independent worker carrying on qualifying 4/1(b) activity | Their own income-tax and independent social-security obligations | 2026 non-wage taxable income is subject to the applicable 15%–40% bands. The monthly 4/1(b) premium is TRY 11,808.23, or TRY 10,156.73 only where the stated incentive conditions are met. |
| Client found to be the actual employer | Employee obligations may follow where the facts show dependent work for wages | No single current amount or universal allocation is stated for those obligations. |
| Principal-employer and subcontractor representatives | Registering a sham subcontracting workplace; workers are then treated as the principal employer's workers from the beginning | TRY 302,484 in 2026, imposed separately on the representatives of the principal employer and subcontractor. |
| Employer using temporary workers contrary to Article 7 | A distinct breach of the regulated temporary-work rules | TRY 4,235 per affected worker in 2026. |
The TRY 302,484 figure applies to registration of a sham subcontracting workplace; TRY 4,235 per worker applies to noncompliant regulated temporary supply. Neither is an automatic charge for an independent-services dispute. The 2026 Labour Law administrative-penalty schedule lists those separate fines but gives no universal arrears calculation, lookback period or allocation for ordinary reclassification. For employer duties, see the Turkey employment guide.
Which models fit the work
Direct services and contractor platforms fit independent, output-led work. If the person works dependently for wages, assess an employee route through your entity or a qualified provider.
Direct contractor, Contractor Platform or employment
| Model | Contracting party | Fits when | Recheck |
|---|---|---|---|
| Direct contractor | The client and the independent contractor | The person controls genuinely independent services and the agreement can record scope, acceptance, document route and rights | Reassess the actual relationship as the engagement changes; a services label does not decide status |
| 4dev.com's Contractor Platform | The client and contractor under the applicable platform terms | Genuinely independent contractor work; 4dev.com lists Turkey among its countries available for contractors | Check the actual relationship and the terms that allocate responsibilities; the platform does not make a dependent relationship independent |
| Employment through the client's own entity | The employing entity and employee | The work is dependent and should be run as employment | Confirm the applicable employer setup and employment obligations in the Turkey employment guide |
| Employment through a separately qualified provider | The provider, worker and client under the actual arrangement | An employee route is needed and the provider arrangement is appropriate to the facts | Check the provider's role, authorization where relevant and contractual allocation; a category label does not itself establish liability or cure an earlier classification issue |
“Contractor of record” describes a category of arrangement, not a statutory conclusion or a promised indemnity. Its legal effect and any allocation of responsibility depend on the actual structure and terms.
If the relationship is dependent, move the forward-looking engagement onto an employment route rather than relying on contractor paperwork. The Turkey employer of record guide explains the provider route; it does not supply a universal legality finding or a retrospective cure for a prior arrangement.
One Turkish contractor versus ten
Ten contractors create ten status and document trails, each tied to the work actually done. The number itself creates no separate legal status or statutory crossover.
| Record | One contractor | Ten contractors |
|---|---|---|
| Status | Test the person's actual relationship and the applicable 4/1(a) employee or qualifying 4/1(b) independent route | Keep the same status test for every person; a common role title or template does not settle each relationship |
| Registration and document | Match the person's professional or commercial status to the relevant notice, ledger and receipt or fatura route | Track the applicable route and deadline per person, without applying the professional sequence to every contractor |
| Agreement and rights | Keep scope, changes, acceptance and separately specified economic-rights terms in one file | Keep the same evidence for each engagement; a standard form cannot replace a person's scope, approval trail or rights specification |
| VAT and currency | Test the actual service, customer, use and parties | Record the VAT export-use and resident-pair currency decisions for each relevant engagement |
| Exit | Record accepted work, handover and the contractual exit trigger | Maintain a per-person record of accepted work and exit or renewal triggers |
For a team, record each person's status review, tax-document route, VAT-use decision, economic-rights terms, accepted deliverables and exit trigger. Keep the agreement and supporting evidence behind each entry. A shared template cannot establish that every engagement is independent.
Who works with contractors in Turkey
Contractor platforms structure existing engagements; freelancer marketplaces offer a way to find Turkish specialists. The right route still depends on the actual working relationship.

Frequently asked questions
Can I hire an international contractor in Turkey without opening a company?
Yes, a foreign client can commission genuinely independent services in Turkey. The actual working relationship still decides whether the arrangement is independent or employment, so dependent work needs an employee route rather than contractor paperwork; see the Turkey employment guide for that route.
Must a Turkish contractor have a sole proprietorship?
There is no single form that applies to every contractor. A qualifying independent professional has the tax-office and recordkeeping steps described above, including a start notice within 10 days, while a commercial trader's registration and document route depend on that person's actual status.
How many hours can a Turkish contractor work for one client?
An hours count alone cannot establish independence. Review control, integration and whether the person works on their own account; a single-client rule is no substitute for those facts.
Does a Turkish professional send an invoice or an e-SMM receipt?
An independent professional issues a serbest meslek makbuzu for each professional collection; e-SMM is the electronic professional-receipt route, with application due by the end of the third month after the starting month. A trader's required fatura follows a separate document route, so an e-SMM receipt is not a universal substitute for an invoice.
Does a foreign customer mean no Turkish VAT?
No. The VAT export exemption requires both a customer abroad and use of the service abroad; foreign billing by itself does not meet that test. Where a service is taxable and outside the reduced-rate lists, the general VAT rate is 20%.
Can a Turkish contractor invoice in euros or dollars?
For a service contract between two Turkish residents, foreign-currency or FX-indexed pricing is generally restricted, subject to stated exceptions including export and foreign-currency-earning services. That resident-pair rule does not automatically apply to a contract with a non-resident foreign client.
How long can a client take to pay a contractor in Turkey?
The Article 1530 timing rules apply only to covered commercial-enterprise supply transactions. Within that scope, a valid agreed due date can trigger default without demand; without a valid period, the statutory path normally begins after 30 days, while the ordinary 60-day limit and its exceptions depend on the parties and agreement.
Who pays Turkish tax and SGK for an independent contractor?
A person qualifying for the independent 4/1(b) route has their own income-tax and social-security obligations; 2026 non-wage taxable-income rates run from 15% to 40%, and the stated monthly minimum premium is TRY 11,808.23. The premium is TRY 10,156.73 only where the five-point incentive conditions are met, and it is due by the end of the following month.
