A foreign company can hire in Italy through its own entity, an authorised agency-based employer of record, or a genuinely independent service provider. Direct employment requires the applicable CCNL minimum for the worker’s category and level; the contractor route requires independence in practice. Paid work under an entrepreneur’s direction is subordinate work, and a predominantly personal, continuous collaboration organised by the client may attract employment protections, subject to statutory exceptions.

4dev.com is a global contractor platform working with contractors in Italy through its Contractor Platform for independent services.

Three ways to hire in Italy

The legal employer and exit terms differ across the three routes. An agency arrangement requires an authorised work agency; independent services require a genuinely independent working relationship.

RouteLegal employerWhat you pay on top of salaryHow you end it
Your own entityYour Italian entity, under the applicable CCNL. (Ministry minimum-pay guide)23.81% is the ordinary employer FPLD IVS pension component for general FPLD members only; other INPS items, INAIL, TFR and CCNL amounts vary. (INPS Circular 101/2024; INPS contribution rates)Apply the relevant CCNL notice or payment in lieu. H011 employer-dismissal notice is 15–120 days (H011) by level and tenure, so it is not a national notice rule. (H011 CCNL; Ministry termination guide)
Employer of recordThe authorised agency, which places its employee with the user. (Agency supply law; Agency register law)Request a quote for the specific agency arrangement. Assigned workers must receive treatment at least equal to comparable user employees, and the user is jointly liable with the agency for remuneration and social contributions. (Agency equal-treatment law)Apply the arrangement terms; the agency remains the employer while the user directs and controls the assigned work. (Agency supply law)
ContractorNo employer, where a service is genuinely independent and without a subordination bond. (Civil Code — independent work)There is no employee salary in a genuine independent-service relationship, so an employee pension component is not a cost proxy. (Civil Code — independent work)Apply the service-contract terms and revisit status where the client directs the work or organises a predominantly personal, continuous collaboration. (Civil Code — subordinate work; Client-organised collaboration law; INL Circular 7/2020)

Check the agency’s authorisation and Ministry registration before using the employer of record route: the user directs and controls the assigned worker during the assignment. For a contractor, the working relationship matters more than the label. The inspectorate distinguishes employment protections for a client-organised collaboration from formal reclassification; actual direction may still support a subordinate-work finding. Some collectively regulated collaborations and registered professions are among the listed exceptions and need separate analysis.

The labour market in Italy

In Q2 2026, ISTAT counted 24.363 million employed people and an employment rate of 63.1% among people aged 15–64. Neither national measure tells an employer how many candidates are available now.

Salary reference points

The Q2 2026 figures below are gross contractual cash-pay monthly means. They are neither take-home pay nor annual earnings, and they do not measure offers or pay for a specific role.

Where work is concentrated and how remote work differs

Among municipality residents who worked from home at least some days in 2023, the recorded shares were 38.3% in Milan, 29.4% in Rome, 27.7% in Bologna and 24.6% in Turin. These are remote-work patterns, not current city pay, vacancies or local role supply.

For information and communication services, including software and IT services, the same 2023 census estimates put the national remote-work share at 60.2%. This is a sector-wide national figure, separate from the city shares.

Over 2011–2022, ISTAT grouped Rome, Milan, Venice, Bologna and Florence among metropolitan labour systems with strong employment growth. Rome and Milan together accounted for 49% of Italy’s net employment growth in that period. This historic local-labour-system measure gives no current city salary or vacancy ranking.

Registering as an employer, step by step

The ordinary hire notice comes before work starts. INAIL insurance has a separate work-start clock, while opening an INPS employee contribution position is an initial employer-registration step. The registration channel depends on whether the company is being formed at the same time as its first hire.

StepWhat happensTakes
Form a company and make its first hire togetherUse ComUnica for business registration and the initial INPS matricola DM employee contribution position. This route does not require a second INPS online registration application. (INPS — Iscrizione nuova azienda con dipendenti)At business start with the first hire; no fixed elapsed time
First employee at an existing businessIf the employer does not yet have an employee contribution position, request the initial matricola DM through ComUnica or the INPS online service. (INPS — Iscrizione nuova azienda con dipendenti)Initial application no later than the 16th of the month after the month for which contributions are owed; no fixed elapsed time
Send the ordinary mandatory hire noticeNotify the competent employment service of the new employment relationship. (Decree-Law 510/1996, art. 9-bis; Ministry — Guida alle comunicazioni obbligatorie)By 24:00 on the preceding calendar day; limited statutory, urgent and force-majeure exceptions apply
File the INAIL work/insurance declarationFor work covered by INAIL insurance, declare the work and risk to INAIL when work begins. (DPR 1124/1965, art. 12)At the start of work; only if simultaneous filing is impossible because of the nature or start of work, within five subsequent calendar days
TotalThe steps have separate clocks; there is no fixed company-setup total.Varies

Which clock starts before work?

For an ordinary hire, send the mandatory notice by 24:00 on the preceding calendar day and declare covered work to INAIL on its work-start clock. If the employer still needs its first INPS employee contribution position, register through ComUnica when formation and hiring coincide, or through ComUnica or the INPS online service when an existing business first hires employees. The initial registration application is due no later than the 16th of the month after the month for which contributions are owed; a completed ComUnica registration does not call for a second online application for that hire. The INPS new-employer registration service describes both channels.

UNILAV and covered INAIL have separate clocks. The 16th of the following month concerns opening the initial employer INPS position, not each hire or an extra filing after completed ComUnica registration. Sources: 18, 19, 20, 21.

Hiring and onboarding in Italy

Set the contract type, CCNL and grade before filing the hire notice. Insurance, TFR and immigration requirements have separate conditions and deadlines.

Contracts, CCNL and probation

The employment terms should identify whether the role is permanent, fixed-term or part-time, then apply the CCNL and grade that fit the work and employer’s principal activity. H011’s maximum probation range is 45 days–6 months (H011): six calendar months for levels Q/I, 60 actual workdays for levels II–V, and 45 actual workdays for levels VI/VII. Those H011 limits do not supply a general Italian probation rule for every agreement.

For fixed-term contracts started from 12 January 2025, probation is one actual workday per 15 calendar days, subject to a two-workday minimum. It is capped at 15 actual workdays for a contract of up to six months and 30 actual workdays for one longer than six but shorter than twelve months; more favourable collective terms apply.

Onboarding checklist

  • Record the contract type, the applicable CCNL and the worker’s grade.
  • Complete the ordinary UNILAV notice by 24:00 on the preceding calendar day, unless a statutory exception applies.
  • Check identity and the applicable right-to-work route before the start date.
  • Identify whether the work is covered by INAIL insurance and file the required declaration on its separate work-start clock.
  • Record the worker’s TFR destination choice. For a private-sector first hire from 1 July 2026, the worker has 60 days; the earlier six-month window applies to hires before that date.

When a candidate needs immigration permission

A candidate’s status and proposed work determine the immigration route. Work authorisation and the UNILAV notice follow separate rules. The 2026 flow decree sets 164,850 employment and self-employment entries in total, including 76,200 nonseasonal employment entries, 88,000 seasonal employment entries and 650 self-employment entries.

Where a work nulla osta has been granted, Article 22(6-bis) permits work in Italy while the residence contract is awaiting signature. The ordinary prior-day hire notice still applies. Work-authorisation processing time depends on the individual route.

Minimum wage: the CCNL is the starting point

Italy is CCNL-dependent: there is no single statutory national euro floor, so the applicable collective agreement, sector, category, principal activity and grade determine the relevant pay treatment.

An H011 level IV quote, element by element

For ordinary office staff at level IV under CCNL Terziario Confcommercio H011, a pay quote has separate minimum, contingenza and territorial components. Sector, grade and locality affect the result; this example supplies neither a national minimum nor an all-role total.

Contingenza€524.22H011 CCNL

What changes on 1 November 2026

For this same H011 level-IV example, the published minimo component rises to €1,292.46 on 1 November 2026. A further published tranche takes that component to €1,332.46 on 1 February 2027. Neither future component is a current national floor, and neither replaces contingenza or any applicable territorial element.

Taxes and contributions in Italy

National income-tax bands describe the employee’s marginal tax; employer contribution components describe a different cost. Neither alone yields take-home pay or an all-in employment-cost rate.

Income tax and worker deductions

For 2026, national marginal IRPEF runs from 23–43%: 23% up to €28,000, 33% on the portion above €28,000 through €50,000, and 43% above €50,000. These are marginal bands, not a net-pay calculation.

For general FPLD pension members, the ordinary IVS pension is 9.19% for the employee and 23.81% for the employer. The employee also has a separate 1% pension contribution on pay above the stated 2026 threshold; that does not add to employer cost.

What an employee actually costs you

The 23.81% figure is only the ordinary employer FPLD IVS pension component for general FPLD members. Other INPS components, INAIL, TFR, extra CCNL instalments and benefits vary with the employer, worker and applicable terms, so they are not priced in this comparison.

2026 hiring relief applies only to qualifying permanent hires and has scheme-specific conditions and exclusions, including representative CCNL application and, where required, net employment growth. It cannot replace the ordinary FPLD rate in this illustration.

TFR destination and later headcount

TFR is separate from the pension component: it accrues at no more than annual remuneration divided by 13.5 and is revalued annually by 1.5% plus 75% of consumer-price inflation. For a private-sector first hire from 1 July 2026, the worker has 60 days to choose the TFR destination; the earlier six-month window applies to earlier hires.

For 2026–27 pay periods, a retained-TFR treasury remittance rule uses the preceding calendar year’s average workforce and a 60-worker threshold; reaching that threshold during 2026 can start the obligation with January 2027 pay. It is a destination rule, not a change to TFR accrual.

Working time and overtime in Italy

The normal statutory week is 40 hours unless the applicable CCNL sets a shorter one, while the separate ceiling is a 48-hour weekly average that includes overtime.

Normal working time40 hours each week, unless the CCNL sets lessMinistry — Orario di lavoro
Maximum average, including overtime48 hours a week over the reference periodMinistry — Orario di lavoro

The ordinary reference period is no more than four months. A CCNL may extend it to six months, or to twelve months for specified objective, technical or organisational reasons.

Daily and weekly rest

The ordinary daily rest is 11 consecutive hours in each 24-hour period. A CCNL may derogate only where it provides equivalent compensatory rest.

Weekly rest is ordinarily at least 24 consecutive hours every seven days, normally on Sunday, and is cumulative with the daily rest. It is averaged over no more than 14 days; the law or collective agreements can provide stated exceptions to the weekly cadence or Sunday alignment for particular circumstances or activities.

H011 overtime example

H011 permits up to 250 individual overtime hours a year and gives a 15% premium for hours 41 through 48 in the week. Those are H011 terms, not a nationwide overtime cap or premium.

Leave, sick pay and parental leave

The statutory annual-leave minimum is 4 weeks. Two weeks of that minimum are taken consecutively in the accrual year, with the remainder within 18 months, subject to CCNL variation. H011 allows 26 working days but counts every week as six working days regardless of the actual schedule; that figure is not a universal five-day-week entitlement. Sick-pay entitlement depends on the insured cohort and applicable CCNL.

Who pays during sickness

INPS sickness insurance covers eligible blue-collar and white-collar employees in commerce and services, among other qualifying groups. Industrial office staff, industrial and artisan quadri, and executives are among the exclusions, so no single sick-pay rule applies to all employees.

H011 excludes certain events from the event count used for its first-three-day integration: hospitalisation, day hospital or dialysis; an illness certified with an initial prognosis of at least 12 days; multiple or progressive sclerosis and listed serious conditions documented by national-health-service specialists; and illness during pregnancy. Its top-ups and job-protection period apply only where H011 covers the employee.

Parental and child-related leave

From 2026, employed parents may take parental leave until the child turns 14. Combined parental leave is up to ten months, or eleven where the father takes at least three months; the duration rule does not establish a single paid rate for every month.

For a child aged three to 14, each parent has up to ten days a year for the child’s illness. Eligible employed fathers have ten working days of mandatory paternity leave from two months before birth to five months after it.

Public holidays in Italy include local dates

Italy’s holiday calendar is National + local dates: Law 151/2025 added 4 October, St Francis of Assisi, to the national holiday statute from 1 January 2026.

The locality’s patronal date also affects the calendar. The national addition therefore does not establish a fixed total of national and local holidays or one work-and-pay outcome for every employee; the local calendar, applicable CCNL and statutory rule govern the arrangement. The 4 October date itself fell on a Sunday in 2026.

Termination: notice and payments

The 15–120 days (H011) range applies only to employer dismissal under H011 and varies by level and tenure; it is not a national notice rule. For a justified subjective or objective dismissal, the applicable CCNL normally supplies notice or payment in lieu, while just cause permits immediate dismissal.

How level and tenure change notice

For H011 levels IV and V, employer-dismissal notice is measured in calendar days and starts on the 1st or 16th of the month.

What is paid at exit

Pay accrued TFR separately from any notice payment. The accrual and revaluation formula appears under taxes and contributions; notice pay depends on the applicable CCNL or individual terms. No general damages schedule follows from these rules.

Recent changes to plan around

  • 12 January 2025 — fixed-term probation and agency missions. For fixed-term employment begun on or after this date, probation is one actual workday per 15 calendar days, with a two-workday floor, a 15-workday cap through six months and a 30-workday cap for terms longer than six but shorter than twelve months; more favourable collective terms apply. For qualifying agency–user supply contracts concluded from the same date, fixed-term missions of the same worker at the same user count toward a 24-month user-side limit, subject to statutory and CCNL exceptions.
  • 1 January 2026 — St Francis of Assisi. Law 151/2025 added 4 October to the national holiday statute. Local dates and the applicable CCNL still determine the working calendar for a particular arrangement.
  • **1 May and 28 June 2026 — salario giusto.** Decree-Law 62/2026 entered into force on 1 May and was converted by Law 112/2026 effective 28 June. Its rule refers to total economic treatment under the representative CCNL for the relevant sector, category and employer activity; it does not enact a single national euro floor. The Ministry’s implementation announcement described technical work, not a new pay rule or proof that a system is live.
  • 2026 qualifying permanent hires — conditional relief. Scheme-specific relief is available only for eligible private-employer permanent hires in the covered groups and circumstances. Requirements include representative CCNL application and, where required, net employment growth; public-employer, domestic and apprenticeship relationships are excluded. It does not replace the ordinary FPLD rate for a general cost illustration.
  • 1 July 2026 — first-hire TFR choice. A private-sector first hire from this date has 60 days to choose a TFR destination; the older six-month window applies to earlier hires. Separately, for 2026–27 pay periods, retained-TFR treasury remittance uses the prior calendar year’s average workforce and a 60-worker threshold; growth during 2026 can start the remittance obligation with January 2027 pay. This changes TFR destination, not the accrual formula.
  • **1 November 2026 and 1 February 2027 — H011 level-IV minimo tranches.** The published component is €1,292.46 from 1 November 2026 and €1,332.46 from 1 February 2027. These are H011 level-IV minimo components, not a current national floor or all-in monthly pay; contingenza, locality and other applicable elements remain separate.

What a mistake costs and who pays

Exposure depends on the legal relationship. The labour-supply amounts below apply only to qualifying unlawful or fraudulent somministrazione; the contractor row describes classification risk without a fixed monetary amount.

(Civil Code art. 2094; Legislative Decree 81/2015, art. 2; INL Circular 7/2020)

Assigned workers must receive overall economic and normative treatment no less favourable than comparable user employees doing equal duties. The agency and user share liability for remuneration and social contributions; the agency contract does not automatically transfer every employment liability to the user.

Check the agency route before the assignment starts

For permanent agency supply, the user’s baseline limit is 20% of its permanent workforce at 1 January. Direct fixed-term contracts and fixed-term agency supply are generally capped together at 30% of that workforce. Statutory exceptions and collective-agreement changes can matter, so confirm the user’s applicable CCNL and the agency’s register position; route-by-route registry analysis belongs in the Italy employer-of-record guide.

Do not treat a contractor label as the test

An independent service is mainly performed without a subordination bond. Paid work under the entrepreneur’s direction is subordinate work; separately, Article 2 extends subordinate-employment discipline to the client-organised collaboration described in the table. Article 2 has listed exceptions, and hetero-organisation alone does not automatically formally reclassify a relationship—although actual direction can support a subordinate-work finding.

Questions people actually ask

Is there a minimum wage in Italy in 2026?

Italy does not have one statutory euro minimum that applies across every job. The applicable CCNL determines the relevant minimum by sector, category and level; the H011 level-IV minimo is one agreement-specific reference, not a national floor.

What is the average salary in Italy per month?

ISTAT recorded a €2,487 gross monthly contractual cash-pay mean for the total economy in Q2 2026. The industry-and-market-services mean was €2,551 for the same measure and period; neither figure is an offer rate, a tech-role salary or an annualised salary.

How many salary instalments does an Italian employer pay?

There is no single answer for all employment in Italy. H011 provides for a 13th and 14th monthly instalment, but the applicable CCNL and employment terms determine the arrangement for a particular worker.

What must be filed before an employee starts work?

The ordinary mandatory hire notice is due by 24:00 on the preceding calendar day, subject to limited statutory exceptions, and covered INAIL work has a separate work-start filing. An employer opening its first INPS employee contribution position uses ComUnica if formation and hiring coincide; an existing business first hiring employees can use ComUnica or the INPS online service. That initial application is due no later than the 16th of the month after the month for which contributions are owed; an employer with an existing position does not make a new registration application for each hire.

Can a foreign company hire in Italy without opening a local entity?

An authorised work agency can be the legal employer and place its employee with the user, which directs and controls the assigned work. Confirm the agency’s registration and authorisation, equal treatment for assigned workers and the user’s joint liability for remuneration and contributions; the Italy employer-of-record guide explains that route. A foreign company can also contract for genuinely independent services without making the provider its employee, but the work must remain independent in practice rather than directed or client-organised as a predominantly personal, continuous collaboration. The Italy independent-contractors guide covers that boundary.

Do Italians work 40 hours a week?

The statutory normal weekly time is 40 hours. A 48-hour average maximum including overtime applies over the relevant reference period; an H011 250-hour annual cap and 15% premium for hours 41–48 are an agreement example, not nationwide terms.

How much notice must an employer give?

Notice depends on the applicable CCNL and the circumstances. H011 employer-dismissal notice ranges from 15–120 days (H011) by level and tenure; this is not a national notice period. For justified dismissal, the relevant CCNL normally supplies notice or payment in lieu, while just cause permits immediate dismissal.

Does a non-EU hire need permission before starting work?

The 2026 flow-decree quotas distinguish nonseasonal employee, seasonal and self-employment entries. Where the nulla osta has been granted, the worker may work while awaiting the residence-contract signature; check the individual route and filing obligations rather than assuming one processing timetable.
