In Italy, an employer of record arrangement can use authorised somministrazione: an agency employs the worker, while the user company directs and controls the assignment. The contracts and agency authorisation determine whether that route applies; the worker’s equal-treatment rights and the user’s joint obligations for remuneration and social contributions still matter. Compare direct employment in Hiring in Italy with genuinely independent services in Hiring contractors in Italy.

4dev.com is a global contractor platform working with contractors in Italy for genuinely independent services through its Contractor Platform; it is not an Employer of Record.

What an employer of record is in Italy

An employer of record is a commercial label for an employment arrangement. Under Italy’s somministrazione route, an authorised agency employs the worker and assigns them to a user company that directs the work. Whether a proposed arrangement qualifies depends on the supply and employment contracts, agency authorisation, equal treatment and the user’s continuing joint obligations.

An EOR arrangement can be lawful in Italy when it qualifies as authorised somministrazione. The provider’s label alone cannot establish that qualification.

The authorised somministrazione route

Under Article 30 of Legislative Decree 81/2015, an authorised agency makes its own employee available to a user company. During the assignment, the employee works in the user’s interest and under the user’s direction and control.

What the EOR label cannot prove

Check the agency’s authorisation in the Ministry register and identify the agency, user and employee in the contracts. The assigned worker must receive treatment at least equal to comparable user employees. The user remains jointly liable with the agency for remuneration and social contributions, regardless of the EOR label.

Agency registration: what to check before signing

Before signing, match the exact legal entity in the proposed contract to an authorised labour-supply entry in the Ministry register; an EOR brand is not evidence of authorisation.

Match the contracting entity to its authorisation

Use the Ministry’s agency-register search to search by tax code, VAT number, legal name, location or section. Compare the contracting entity’s legal name with the entry, then inspect its status and whether the entry is in the relevant generalist or specialist labour-supply section; the register is the statutory mechanism that links registration and authorisation.

Check the employment and supply documents

The supply and employment documents should name the employing agency and user company, the applicable CCNL and level, the parity items, and the assignment and end terms. They should also show who directs the work and how the user’s equal-treatment and joint remuneration-and-contribution duties are addressed.

Who signs what, and who directs the work

The agency, user company and employee have separate roles: the agency employs the worker, while the user directs the assigned work and retains duties that the agency arrangement does not remove.

EmployeeEmployment contract with the agencyPerforms the assignment in the user company’s interest and under its direction and control; receives treatment at least equal to comparable user employees.

The labour-supply contract governs the agency–user relationship, while the employment contract governs the agency–employee relationship. The documents should separately state what ends the assignment and what happens to the employment relationship, rather than treating those as the same question.

In a FeLSA CISL article, Franco Abitante describes the user’s disclosure duty:

“The user company or entity must inform the labour-supply agency about all agreements that affect economic treatment.”

— Franco Abitante, Article author, FeLSA CISL (translated from Italian)

Hiring through an Italian agency, step by step

The agency must file the ordinary hire notice before work starts and, for covered work, the INAIL declaration when work begins. These deadlines do not establish a total EOR onboarding time.

Before the employee starts

Before the agency prepares its quote and documents, the user company should provide the role, applicable CCNL and level, the actual parity package, and right-to-work details. For an ordinary hire, the agency’s mandatory notice to the employment office is due by 24:00 on the preceding day, subject to limited urgent and force-majeure exceptions.

At and after commencement

StepAgency actionClient inputLegal clock

At the startFile the INAIL work and insurance declaration where the work is coveredWork and risk details needed for the filingWhen work begins; within five subsequent days only where simultaneous filing was impossible because of the nature or start of work

If the agency is opening an INPS employer contribution position because it is starting activity with employees, its application is due by the contribution-payment deadline: the 16th day of the month after the month for which contributions are owed. This is an initial employer setup step, not a filing for each worker hired.

A non-EU hire adds an immigration track

Where a non-EU hire requires immigration permission, that track does not displace the ordinary employment notice. If a work nulla osta has been granted, work may begin while the residence contract awaits signature, but the employer must still make the ordinary mandatory notice.

For an ordinary agency hire, the prior-day notice and covered INAIL filing are separate clocks. The 16th of the following month applies only when an employer opens an INPS contribution position, not to every hire. Sources: 4, 8, 9, 10, 11, 12, 13.

What an Italian EOR costs: the quote, line by line

An Italian EOR quote should separate the CCNL-based pay package, applicable employment costs and the negotiated agency charge. These variable items do not yield a universal all-in rate.

Pay and parity inputs

Italy has no single statutory national pay amount: the relevant CCNL depends on the worker’s sector, category and level, while agency-worker parity can also include second-level economic agreements. The user company therefore needs to give the agency its actual package before the quote is built.

H011 is an illustration, not a national floor or a quote for every role. For H011 level IV, the table lists a €1,257.46 minimum component and €524.22 contingenza from 1 November 2025, and the agreement provides 14 salary payments; sector, level and local terms still determine the applicable package.

Employment cost and provider charge

For an ordinary member of the general FPLD pension fund, the employer IVS pension component is 23.81% of taxable pay. That is not total employer contributions: other INPS items vary by activity, company size and worker category, while INAIL, TFR, CCNL benefits or extra salary items, and the separately negotiated agency charge require their own lines.

Monthly salary plus the selected pension component

The table applies only the selected employer FPLD IVS pension component to two observed Q2 2026 monthly means for gross contractual cash pay.

Total economy, Q2 2026 observed monthly mean€2,487 gross contractual cash pay → €592.15 selected employer FPLD IVS pension → €3,079.15 salary plus selected pensionISTAT — Il mercato del lavoro – II trimestre 2026
Industry and market services (B–N), Q2 2026 observed monthly mean€2,551 gross contractual cash pay → €607.39 selected employer FPLD IVS pension → €3,158.39 salary plus selected pensionISTAT — Il mercato del lavoro – II trimestre 2026

Both illustrations assume an ordinary FPLD member, no relief and an annual pension cap that has not been exhausted. They exclude other INPS components, INAIL, TFR, extra CCNL salary or benefits, and the provider charge; they are not total employment cost and do not support an annual forecast.

What happens to TFR

TFR accrues annually at no more than annual remuneration divided by 13.5, then carries annual revaluation of 1.5% plus 75% of consumer-price inflation. A private-sector first hire from 1 July 2026 has 60 days to choose its destination; for earlier hires, the prior six-month window applies. See Hiring in Italy for the wider direct-employer cost treatment.

Sickness treatment also belongs in the quote review: eligibility and the responsible payer vary, while the H011 top-up rules apply only within that agreement’s covered scope. Ask the agency to itemise the actual CCNL treatment alongside the other components.

Where the agency model runs out in Italy

Agency supply does not remove user-company capacity limits, parity duties or the need to separate an assignment’s end from the employee’s contract.

Headcount and mission clocks

Permanent agency supplyGenerally 20% of the user’s permanent workforce at 1 JanuaryDecreto legislativo 15 giugno 2015, n. 81, art. 31
Fixed-term agency supply plus direct fixed-term contractsGenerally 30% of the user’s permanent workforce at 1 JanuaryDecreto legislativo 15 giugno 2015, n. 81, art. 31

Both are statutory baselines, not unconditional quotas: collective agreements and statutory exceptions can change the result for a particular user company.

For agency–user supply contracts concluded from 12 January 2025, fixed-term missions of the same worker at the same user count toward a 24-month user-side limit, including where the agency employs the worker indefinitely. The Ministry guidance counts the relevant post-12-January periods; statutory and CCNL exceptions require a separate check, and exceeding the limit can create an indefinite employment relationship with the user.

Ending an assignment is not automatically ending employment

The commercial assignment and the agency’s employment contract need separate exit terms. H011 is only an example: employer-dismissal notice ranges from 15 to 120 calendar days by level and tenure; at levels IV/V it is 20 days through five years, 30 days from five to ten years, and 45 days above ten years. TFR accrual is also a separate employment item, so it should not be folded into an assignment-end instruction.

Permanent establishment, IP and non-compete

Ask the agency and the user company to identify who assesses the role’s local business presence, which contract governs rights in the work, and which non-compete or post-assignment restrictions apply. Do not assume a permanent-establishment safe harbour, automatic IP transfer or a standard non-compete outcome for every agency arrangement.

Agency or user, as applicableFraudulent supply or use€120 per worker-day; €5,000 minimum and €50,000 maximum
User companyAssigned worker’s remuneration and social contributionsJointly liable with the agency

These rows do not establish that an agency indemnifies the user. The contracts should state the allocation of obligations and any indemnity clause before the arrangement begins.

When you do not need an EOR for an Italian hire

An agency arrangement may be unnecessary where the company already has a valid Italian direct-employer setup, or where the work is genuinely independent rather than an employment relationship in another label.

Direct employment through a valid setup

An employer beginning activity with employees needs an INPS contribution position. A company formed while hiring can use ComUnica for its business-register and contribution-position setup. Those registration routes do not establish a universal right for an unestablished foreign company to hire directly without an Italian entity; the proposed structure needs a case-specific registration and legal review.

Genuinely independent services

The independent-services route fits work performed without a subordination bond. It does not fit simply because the individual holds a Partita IVA: paid work under the entrepreneur’s direction is subordinate work, and predominantly personal, continuous work whose performance is organised by the client can attract employment protections, subject to listed exceptions.

Use Hiring in Italy for the direct-employer route and Hiring contractors in Italy for the independence tests and contractor documentation.

Alternatives and the decision that separates them

The decision turns on who is the legal employer or contracting party and who directs the work, not on whether a provider uses an EOR, PEO or administrator label.

RouteLegal employer or contracting partyWho controls workMain check or exit
Own Italian entityThe Italian entityThe entity as employerApply the correct CCNL and employer-registration, employment and exit rules.
Authorised agency supplyThe authorised agency employs its worker; the agency and user sign the supply contractThe user directs and controls the assignmentMatch the agency to the Ministry register, test workforce baselines and inspect joint-duty terms.
Direct employment through a registered setupThe employer named in the valid employment and registration structureThat employerConfirm that the proposed route is available and complete the relevant registration; those steps do not establish a universal no-entity route.
Genuinely independent servicesThe client contracts with an independent service provider; there is no employer in a genuine independent relationshipThe provider performs without a subordination bondTest the facts of the relationship, including client direction and client-organised continuous work.

A PEO or administrator label does not identify the legal employer. The contract should identify the employer and the party responsible for statutory employment obligations.

How to choose an Italian EOR provider

Check the contracting entity, employment documents, cost lines and user-side limits before choosing an Italian EOR provider.

  • Search the Ministry agency register for the exact legal name in the proposed contract, then match the status, relevant labour-supply section and authorisation.
  • Read both the agency–user supply contract and the agency–employee employment contract. They should identify the CCNL, level, second-level economic terms and the information the user must provide for parity treatment.
  • Request a sample itemisation that separates salary instalments, the ordinary FPLD IVS component, other applicable INPS items, INAIL, TFR, CCNL benefits or extra payments, and the negotiated agency charge. The 23.81% employer FPLD IVS share is not a complete employment-cost figure.
  • Identify who files the ordinary prior-day notice and the covered INAIL declaration at work start. If the agency must open an INPS employer contribution position, confirm that separate setup application and its deadline.
  • Test the user’s permanent and fixed-term workforce against the applicable agency-supply baselines and exceptions before adding another assigned worker.
  • Separate the assignment-end terms from the employment-contract exit terms, and read any indemnity clause rather than assuming that the agency takes over the user’s obligations.

Questions people actually ask

Is an employer of record legal in Italy?

It can be, where the actual arrangement qualifies as authorised somministrazione. The agency must be authorised, it employs the assigned worker, and the user directs and controls the work; an EOR label alone does not establish those facts.

Does an EOR need a licence in Italy?

The relevant labour-supply agency needs authorisation connected to registration in the Ministry register. Check the exact contracting legal entity, its status and its labour-supply section in the register rather than treating a provider brand as proof.

How much does an EOR cost in Italy?

No single all-in amount follows from the CCNL, level, parity package, other contributions, INAIL, TFR and agency charge; those items vary by engagement. For an ordinary FPLD member, €2,487 of observed Q2 2026 gross contractual cash pay produces a selected employer IVS pension component of €592.15, or €3,079.15 including salary and that selected component only. That illustration excludes other INPS items, INAIL, TFR, CCNL extras and the provider charge, so it is not total employment cost or an annual forecast.

Can I hire directly without an Italian entity?

Employer-registration routes exist, but they do not establish a universal right for an unestablished foreign company to hire directly without an Italian entity. Confirm the registration and legal structure available for the proposed arrangement before choosing direct employment.

How long does EOR hiring take in Italy?

The filing deadlines do not give a universal onboarding time. The ordinary hire notice is due by 24:00 on the preceding day; covered INAIL work is declared when work begins, except for the narrow five-subsequent-day exception. The following-month INPS deadline applies only if the agency needs to open an employer contribution position when starting activity with employees; it is not a per-hire enrolment deadline.

Who is responsible if remuneration or contributions are missed?

The user is jointly liable with the agency for the assigned worker’s remuneration and social contributions. That statutory rule does not show that the agency indemnifies the user, so read the contract’s allocation and indemnity wording separately.

How many agency workers can one user take?

For permanent agency supply, the general baseline is 20% of the user’s permanent workforce at 1 January. Fixed-term agency supply plus direct fixed-term contracts has a general combined 30% baseline; collective agreements and statutory exceptions can change either result.

Can an EOR hire a non-EU employee?

The immigration route depends on the worker and proposed role; an agency arrangement does not bypass it. Where a work nulla osta has been granted, work may begin while the residence contract awaits signature, but the employer must still make the ordinary mandatory notice.
